| 1 | AMENDMENT TO SENATE BILL 191 | ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 191 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The Illinois Vehicle Code is amended by adding | ||||||
| 5 | Section 12-826 as follows: | ||||||
| 6 | (625 ILCS 5/12-826 new) | ||||||
| 7 | Sec. 12-826. Seat safety belts required. | ||||||
| 8 | (a) Beginning July 1, 2031, each designated seating | ||||||
| 9 | position in any newly purchased school bus shall be equipped | ||||||
| 10 | with a combination pelvic and upper torso seat safety belt | ||||||
| 11 | system (also known as a 3-point seat safety belt, Type 2 seat | ||||||
| 12 | safety belt, or lap and shoulder restraint system) in good | ||||||
| 13 | operating condition and meeting all applicable federal | ||||||
| 14 | standards. | ||||||
| 15 | (b) Nothing in this Section requires a public or nonpublic | ||||||
| 16 | school, school district, transportation provider or | ||||||
| |||||||
| |||||||
| 1 | contractor, or other entity operating a school bus, including | ||||||
| 2 | a bus driver, bus aide, volunteer, or other staff, to ensure | ||||||
| 3 | that the seat safety belt or other restraint system is | ||||||
| 4 | correctly adjusted and fastened or to give instruction on how | ||||||
| 5 | to correctly adjust or fasten the seat safety belt or other | ||||||
| 6 | restraint system. | ||||||
| 7 | (c) This Section does not apply to a school bus that is | ||||||
| 8 | leased by a school district or a school bus that is legally | ||||||
| 9 | registered in another state and displaying valid registration | ||||||
| 10 | plates of that state if the bus is not operated in Illinois in | ||||||
| 11 | connection with a cultural, tourist, athletic, or other | ||||||
| 12 | similar activity for students enrolled in a school located | ||||||
| 13 | outside of Illinois. | ||||||
| 14 | (d) As used in this Section, "school bus" has the meaning | ||||||
| 15 | given to that term in Section 1-182. | ||||||
| 16 | Section 99. Effective date. This Act takes effect upon | ||||||
| 17 | becoming law.". | ||||||
