AMENDMENT TO SENATE BILL 594

AMENDMENT NO. ______. Amend Senate Bill 594 by replacing everything after the enacting clause with the following:

"Section 5. The Mental Health and Developmental Disabilities Code is amended by changing Section 1-129 as follows:

(405 ILCS 5/1-129)

Sec. 1-129. Mental illness. "Mental illness" means a mental, or emotional disorder that substantially impairs a person's thought, perception of reality, emotional process, judgment, behavior, or ability to cope with the ordinary demands of life, but does not include a developmental disability, dementia or Alzheimer's disease absent psychosis, a substance use disorder, or an abnormality manifested only by repeated criminal or otherwise antisocial conduct. "Mental illness" also does not include: (i) identifying as having a diverse sexual orientation, including, but not limited to, lesbian, gay, bisexual, queer, pansexual, asexual, or questioning; (ii) engaging in consensual sexual activity, including consensual same-sex sexual activity; (iii) identifying as having a diverse gender identity, including, but not limited to, transgender, non-binary, or gender-non-conforming or seeking to affirm or express one's gender identity, except when conditions are met for a diagnosis of gender dysphoria; (iv) behaving, expressing, dressing, styling, or otherwise adorning, grooming, or styling one's body, face, or hair in a way that is perceived or interpreted to be incongruent with social norms or one's assigned sex at birth, except when conditions are met for a diagnosis of gender dysphoria; or (v) the conditions of someone's living arrangements or circumstances, such as being unhoused.
