AMENDMENT TO SENATE BILL 1258

2    AMENDMENT NO. ______. Amend Senate Bill 1258 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Prior Authorization Reform Act is amended
5by adding Section 52 as follows:
 
6    (215 ILCS 200/52 new)
7    Sec. 52. Prior authorization prohibited.
8    (a) A health insurance issuer may not require prior
9authorization for:
10        (1) a prescription drug prescribed to a patient by a
11    health care professional for 6 or more consecutive months,
12    regardless of whether the prescription drug is a
13    non-preferred medication pursuant to the patient's health
14    insurance coverage;
15        (2) the following prescription drugs or the
16    therapeutic equivalent approved by the United States Food

1    and Drug Administration: insulin; human immunodeficiency
2    virus prevention medication; human immunodeficiency virus
3    treatment medication; viral hepatitis medication;
4    estrogen; and progesterone; or
5        (3) human immunodeficiency virus pre-exposure
6    prophylaxis and post-exposure prophylaxis drugs approved
7    by the United States Food and Drug Administration;
8    Truvada; Harvoni; Descovy; and Apretude.
9    (b) This Section of the Prior Authorization Reform Act
10does not apply to health insurance coverage or policies issued
11or delivered pursuant to the State Employees Group Insurance
12Act of 1971 or the Health Maintenance Organization Act.
 
13    Section 99. Effective date. This Act takes effect January
