AMENDMENT TO SENATE BILL 1259

2    AMENDMENT NO. ______. Amend Senate Bill 1259 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Insurance Code is amended by
5adding Section 356z.32a as follows:
 
6    (215 ILCS 5/356z.32a new)
7    Sec. 356z.32a. Coverage for standard fertility
8preservation services.
9    (a) As used in this Section, "standard fertility
10preservation services" means procedures based upon current
11evidence-based standards of care established by the American
12Society for Reproductive Medicine, the American Society of
13Clinical Oncology, or other national medical associations that
14follow current evidence-based standards of care, including,
15but not limited to, cryopreservation.
16    (b) An individual or group policy of accident and health

1insurance amended, delivered, issued, or renewed in this State
2after January 1, 2028 must provide coverage for expenses for
3standard fertility preservation services and follow-up
4services related to that coverage, including storage.
5    (c) In determining coverage under this Section, an insurer
6shall not discriminate based on an individual's:
7        (1) expected length of life, present or predicted
8disability, degree of medical dependency, quality of life, or
9other health conditions; or
10        (2) personal characteristics, including age, sex,
11sexual orientation, or marital status.
12    (d) An individual or group policy of accident and health
13insurance may not:
14        (1) impose any exclusions, limitations, or other
15    restrictions on coverage of standard fertility
16    preservation services that are different from those
17    imposed on any other prescription medications;
18        (2) impose any exclusions, limitations, or other
19    restrictions on coverage of any standard fertility
20    preservation services based on a covered individual's
21    participation in fertility services provided by or to a
22    third party; or
23        (3) impose deductibles, copayments, coinsurance,
24    benefit maximums, waiting periods, or any other
25    limitations on coverage for standard fertility
26    preservation services that are different from those

1    imposed upon benefits for services not related to
2    fertility.
 
3    Section 99. Effective date. This Act takes effect January
41, 2028.".
