AMENDMENT TO SENATE BILL 1295

2    AMENDMENT NO. ______. Amend Senate Bill 1295, on page 2,
3line 5, by replacing "emergency medical dispatch, and" with
4"emergency medical dispatch, and"; and
 
5on page 2, line 11, by replacing "emergency medical dispatch,
6and" with "emergency medical dispatch, and"; and
 
7on page 4, immediately below line 15, by inserting the
8following:
 
9    "Section 10. The Emergency Medical Services (EMS) Systems
10Act is amended by changing Section 3.70 as follows:
 
11    (210 ILCS 50/3.70)
12    Sec. 3.70. Emergency Medical Dispatcher.
13    (a) "Emergency Medical Dispatcher" means a person who has
14successfully completed a training course in emergency medical

1dispatching and telecommunicator cardiopulmonary
2resuscitation (T-CPR) in accordance with rules adopted by the
3Department pursuant to this Act, who accepts calls from the
4public for emergency medical services and dispatches
5designated emergency medical services personnel and vehicles.
6The Emergency Medical Dispatcher must use the
7Department-approved emergency medical dispatch priority
8reference system (EMDPRS) protocol selected for use by its
9agency and approved by its EMS medical director. This protocol
10must be used by an emergency medical dispatcher in an
11emergency medical dispatch agency to dispatch aid to medical
12emergencies which includes systematized caller interrogation
13questions; systematized prearrival support instructions; and
14systematized coding protocols that match the dispatcher's
15evaluation of the injury or illness severity with the vehicle
16response mode and vehicle response configuration and includes
17an appropriate training curriculum and testing process
18consistent with the specific EMDPRS protocol used by the
19emergency medical dispatch agency. Prearrival support
20instructions shall be provided in a non-discriminatory manner
21and shall be provided in accordance with the EMDPRS
22established by the EMS medical director of the EMS system in
23which the EMD operates. If the dispatcher operates under the
24authority of an Emergency Telephone System Board established
25under the Emergency Telephone System Act, the protocols shall
26be established by such Board in consultation with the EMS

1Medical Director.
2    (b) The Department shall have the authority and
3responsibility to:
4        (1) Require licensure and relicensure of a person who
5    meets the training and other requirements as an emergency
6    medical dispatcher pursuant to this Act.
7        (2) Require licensure and relicensure of a person,
8    organization, or government agency that operates an
9    emergency medical dispatch agency that meets the minimum
10    standards prescribed by the Department for an emergency
11    medical dispatch agency pursuant to this Act.
12        (3) Prescribe minimum education and continuing
13    education requirements for the Emergency Medical
14    Dispatcher, which meet standards specified by rules
15    adopted pursuant to this Act.
16        (4) Require each EMS Medical Director to report to the
17    Department whenever an action has taken place that may
18    require the revocation or suspension of a license issued
19    by the Department.
20        (5) Require each EMD to provide prearrival
21    instructions and telecommunicator cardiopulmonary
22    resuscitation (T-CPR) in compliance with protocols
23    selected and approved by the system's EMS medical director
24    and approved by the Department.
25        (6) Require the Emergency Medical Dispatcher to keep
26    the Department currently informed as to the entity or

1    agency that employs or supervises his activities as an
2    Emergency Medical Dispatcher.
3        (7) Establish an annual relicensure requirement that
4    requires medical dispatch-specific continuing education as
5    prescribed by the Department through rules adopted
6    pursuant to this Act.
7        (8) Approve all EMDPRS protocols used by emergency
8    medical dispatch agencies to assure compliance with
9    national standards.
10        (9) Require that Department-approved emergency medical
11    dispatch training programs are conducted in accordance
12    with national standards.
13        (10) Require that the emergency medical dispatch
14    agency be operated in accordance with national standards,
15    including, but not limited to, (i) the use on every
16    request for medical assistance of an emergency medical
17    dispatch priority reference system (EMDPRS) in accordance
18    with Department-approved policies and procedures and (ii)
19    under the approval and supervision of the EMS medical
20    director, the establishment of a continuous quality
21    improvement program.
22        (11) Require that a person may not represent himself
23    or herself, nor may an agency or business represent an
24    agent or employee of that agency or business, as an
25    emergency medical dispatcher unless licensed by the
26    Department as an emergency medical dispatcher.

1        (12) Require that a person, organization, or
2    government agency not represent itself as an emergency
3    medical dispatch agency unless the person, organization,
4    or government agency is certified by the Department as an
5    emergency medical dispatch agency.
6        (13) Require that a person, organization, or
7    government agency may not offer or conduct a training
8    course that is represented as a course for an emergency
9    medical dispatcher unless the person, organization, or
10    agency is approved by the Department to offer or conduct
11    that course.
12        (14) Require that Department-approved emergency
13    medical dispatcher training programs are conducted by
14    instructors licensed by the Department who:
15            (i) are, at a minimum, licensed as emergency
16        medical dispatchers;
17            (ii) have completed a Department-approved course
18        on methods of instruction;
19            (iii) have previous experience in a medical
20        dispatch agency; and
21            (iv) have demonstrated experience as an EMS
22        instructor.
23        (15) Establish criteria for modifying or waiving
24    Emergency Medical Dispatcher requirements based on (i) the
25    scope and frequency of dispatch activities and the
26    dispatcher's access to training or (ii) whether the

1    previously-attended dispatcher training program merits
2    automatic relicensure for the dispatcher.
3        (16) Charge each Emergency Medical Dispatcher
4    applicant a fee for licensure and license renewal.
5    (c) The Department shall have the authority to suspend,
6revoke, or refuse to issue or renew the license of an EMD when,
7after notice and the opportunity for an impartial hearing, the
8Department demonstrates that the licensee has violated this
9Act, violated the rules adopted by the Department, or failed
10to comply with the applicable standard of care.
