| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Renewable Energy Production District Act is |
| 5 | | amended by changing Section 5 as follows: |
| 6 | | (70 ILCS 1950/5) |
| 7 | | Sec. 5. Definitions. "Board" means the board of trustees |
| 8 | | of a renewable energy production special district created |
| 9 | | under this Act. |
| 10 | | "District" means a renewable energy production special |
| 11 | | district created under this Act. |
| 12 | | "Renewable energy facility" means a generator that is |
| 13 | | attached to a building or parcel of land and that is powered by |
| 14 | | methane gas generated from landfills, solar electric energy or |
| 15 | | wind, dedicated crops grown for electricity generation, |
| 16 | | anaerobic digestion of livestock or food processing waste, |
| 17 | | fuel cells or microturbines powered by renewable fuels, or |
| 18 | | hydroelectric energy. "Renewable energy facility" includes a |
| 19 | | small modular reactor. "Renewable fuels" does not include the |
| 20 | | incineration or burning of tires, garbage, general household, |
| 21 | | institutional, or commercial waste, industrial lunchroom or |
| 22 | | office waste, landscape waste other than tree waste, railroad |
| 23 | | crossties, utility poles, or construction or demolition |
