| 1 | AN ACT concerning local government. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 5. The Illinois State Police Law of the Civil | |||||||||||||||||||
| 5 | Administrative Code of Illinois is amended by changing Section | |||||||||||||||||||
| 6 | 2605-485 as follows: | |||||||||||||||||||
| 7 | (20 ILCS 2605/2605-485) | |||||||||||||||||||
| 8 | Sec. 2605-485. Endangered Missing Person Advisory. | |||||||||||||||||||
| 9 | (a) A coordinated program known as the Endangered Missing | |||||||||||||||||||
| 10 | Person Advisory is established within the Illinois State | |||||||||||||||||||
| 11 | Police. The purpose of the Endangered Missing Person Advisory | |||||||||||||||||||
| 12 | is to provide a regional system for the rapid dissemination of | |||||||||||||||||||
| 13 | information regarding a missing person who is believed to be a | |||||||||||||||||||
| 14 | high-risk missing person as defined in Section 10 of the | |||||||||||||||||||
| 15 | Missing Persons Identification Act. | |||||||||||||||||||
| 16 | (b) The AMBER Plan Task Force, established under Section | |||||||||||||||||||
| 17 | 2605-480 of this Law, shall serve as the task force for the | |||||||||||||||||||
| 18 | Endangered Missing Person Advisory. The AMBER Plan Task Force | |||||||||||||||||||
| 19 | shall monitor and review the implementation and operation of | |||||||||||||||||||
| 20 | the regional system developed under subsection (a), including | |||||||||||||||||||
| 21 | procedures, budgetary requirements, and response protocols. | |||||||||||||||||||
| 22 | The AMBER Plan Task Force shall also develop additional | |||||||||||||||||||
| 23 | network resources for use in the system. | |||||||||||||||||||
| |||||||
| |||||||
| 1 | (c) The Illinois State Police, in coordination with the | ||||||
| 2 | Illinois Department on Aging, shall develop and implement a | ||||||
| 3 | community outreach program to promote awareness among the | ||||||
| 4 | State's healthcare facilities, nursing homes, assisted living | ||||||
| 5 | facilities, and other senior centers. The guidelines and | ||||||
| 6 | procedures shall ensure that specific health information about | ||||||
| 7 | the missing person is not made public through the alert or | ||||||
| 8 | otherwise. | ||||||
| 9 | (c-5) Subject to appropriation, the Illinois State Police, | ||||||
| 10 | in coordination with the Illinois Department of Human | ||||||
| 11 | Services, shall develop and implement a community outreach | ||||||
| 12 | program to promote awareness of the Endangered Missing Person | ||||||
| 13 | Advisory among applicable entities, including, but not limited | ||||||
| 14 | to, developmental disability facilities as defined in Section | ||||||
| 15 | 1-107 of the Mental Health and Developmental Disabilities | ||||||
| 16 | Code. The guidelines and procedures shall ensure that specific | ||||||
| 17 | health information about the missing person is not made public | ||||||
| 18 | through the alert or otherwise. | ||||||
| 19 | (d) The Child Safety Coordinator, created under Section | ||||||
| 20 | 2605-480 of this Law, shall act in the dual capacity of Child | ||||||
| 21 | Safety Coordinator and Endangered Missing Person Coordinator. | ||||||
| 22 | The Coordinator shall assist in the establishment of State | ||||||
| 23 | standards and monitor the availability of federal funding that | ||||||
| 24 | may become available to further the objectives of the | ||||||
| 25 | Endangered Missing Person Advisory. The Illinois State Police | ||||||
| 26 | shall provide technical assistance for the Coordinator from | ||||||
| |||||||
| |||||||
| 1 | its existing resources. | ||||||
| 2 | (e)(1) The Illinois State Police, in cooperation with the | ||||||
| 3 | Silver Search Task Force, shall develop as part of the | ||||||
| 4 | Endangered Missing Person Advisory a coordinated statewide | ||||||
| 5 | awareness program and toolkit to be used when a person 21 years | ||||||
| 6 | of age or older who is believed to have Alzheimer's disease, | ||||||
| 7 | other related dementia, or other dementia-like cognitive | ||||||
| 8 | impairment is reported missing, which shall be referred to as | ||||||
| 9 | Silver Search. | ||||||
| 10 | (2) The Illinois State Police shall complete development | ||||||
| 11 | and deployment of the Silver Search Awareness Program and | ||||||
| 12 | toolkit on or before July 1, 2017. | ||||||
| 13 | (3) The Illinois State Police shall establish a Silver | ||||||
| 14 | Search Task Force within 90 days after the effective date of | ||||||
| 15 | this amendatory Act of the 99th General Assembly to assist the | ||||||
| 16 | Illinois State Police in development and deployment of the | ||||||
| 17 | Silver Search Awareness Program and toolkit. The Task Force | ||||||
| 18 | shall establish the criteria and create a toolkit, which may | ||||||
| 19 | include usage of Department of Transportation signs, under | ||||||
| 20 | Section 2705-505.6 of the Department of Transportation Law of | ||||||
| 21 | the Civil Administrative Code of Illinois. The Task Force | ||||||
| 22 | shall monitor and review the implementation and operation of | ||||||
| 23 | that program, including procedures, budgetary requirements, | ||||||
| 24 | standards, and minimum requirements for the training of law | ||||||
| 25 | enforcement personnel on how to interact appropriately and | ||||||
| 26 | effectively with individuals that suffer from Alzheimer's | ||||||
| |||||||
| |||||||
| 1 | disease, other dementia, or other dementia-like cognitive | ||||||
| 2 | impairment. The Task Force shall also develop additional | ||||||
| 3 | network and financial resources for use in the system. The | ||||||
| 4 | Task Force shall include, but is not limited to, one | ||||||
| 5 | representative from each of the following: | ||||||
| 6 | (A) the Illinois State Police; | ||||||
| 7 | (B) the Department on Aging; | ||||||
| 8 | (C) the Department of Public Health; | ||||||
| 9 | (D) the Illinois Law Enforcement Training Standards | ||||||
| 10 | Board; | ||||||
| 11 | (E) the Illinois Emergency Management Agency and | ||||||
| 12 | Office of Homeland Security; | ||||||
| 13 | (F) the Secretary of State; | ||||||
| 14 | (G) the Department of Transportation; | ||||||
| 15 | (H) the Department of the Lottery; | ||||||
| 16 | (I) the Illinois Toll Highway Authority; | ||||||
| 17 | (J) a State association dedicated to Alzheimer's care, | ||||||
| 18 | support, and research; | ||||||
| 19 | (K) a State association dedicated to improving quality | ||||||
| 20 | of life for persons age 50 and over; | ||||||
| 21 | (L) a State group of area agencies involved in | ||||||
| 22 | planning and coordinating services and programs for older | ||||||
| 23 | persons in their respective areas; | ||||||
| 24 | (M) a State organization dedicated to enhancing | ||||||
| 25 | communication and cooperation between sheriffs; | ||||||
| 26 | (N) a State association of police chiefs and other | ||||||
| |||||||
| |||||||
| 1 | leaders of police and public safety organizations; | ||||||
| 2 | (O) a State association representing Illinois | ||||||
| 3 | publishers; | ||||||
| 4 | (P) a State association that advocates for the | ||||||
| 5 | broadcast industry; | ||||||
| 6 | (Q) a member of a large wireless telephone carrier; | ||||||
| 7 | and | ||||||
| 8 | (R) a member of a small wireless telephone carrier. | ||||||
| 9 | The members of the Task Force designated in subparagraphs | ||||||
| 10 | (A) through (I) of this paragraph (3) shall be appointed by the | ||||||
| 11 | head of the respective agency. The members of the Task Force | ||||||
| 12 | designated in subparagraphs (J) through (R) of this paragraph | ||||||
| 13 | (3) shall be appointed by the Director of the Illinois State | ||||||
| 14 | Police. The Director of the Illinois State Police or the | ||||||
| 15 | Director's his or her designee shall serve as Chair of the Task | ||||||
| 16 | Force. | ||||||
| 17 | The Task Force shall meet at least twice a year and shall | ||||||
| 18 | provide a report on the operations of the Silver Search | ||||||
| 19 | Program to the General Assembly and the Governor each year by | ||||||
| 20 | June 30. | ||||||
| 21 | (4) Subject to appropriation, the Illinois State Police, | ||||||
| 22 | in coordination with the Department on Aging and the Silver | ||||||
| 23 | Search Task Force, shall develop and implement a community | ||||||
| 24 | outreach program to promote awareness of the Silver Search | ||||||
| 25 | Program as part of the Endangered Missing Person Advisory | ||||||
| 26 | among law enforcement agencies, the State's healthcare | ||||||
| |||||||
| |||||||
| 1 | facilities, nursing homes, assisted living facilities, other | ||||||
| 2 | senior centers, and the general population on or before | ||||||
| 3 | January 1, 2017. | ||||||
| 4 | (5) The Child Safety Coordinator, created under Section | ||||||
| 5 | 2605-480 of this Law, shall act in the capacity of Child Safety | ||||||
| 6 | Coordinator, Endangered Missing Person Coordinator, and Silver | ||||||
| 7 | Search Program Coordinator. The Coordinator, in conjunction | ||||||
| 8 | with the members of the Task Force, shall assist the Illinois | ||||||
| 9 | State Police and the Silver Search Task Force in the | ||||||
| 10 | establishment of State standards and monitor the availability | ||||||
| 11 | of federal and private funding that may become available to | ||||||
| 12 | further the objectives of the Endangered Missing Person | ||||||
| 13 | Advisory and Silver Search Awareness Program. The Illinois | ||||||
| 14 | State Police shall provide technical assistance for the | ||||||
| 15 | Coordinator from its existing resources. | ||||||
| 16 | (6) The Illinois State Police shall provide administrative | ||||||
| 17 | and other support to the Task Force. | ||||||
| 18 | (f)(1) The Illinois State Police, in cooperation with the | ||||||
| 19 | Golden Search Task Force, shall develop as part of the | ||||||
| 20 | Endangered Missing Person Advisory a coordinated statewide | ||||||
| 21 | awareness program and toolkit, which shall be referred to as | ||||||
| 22 | the Golden Search, to be used when there is a missing person | ||||||
| 23 | who is believed to be a person having a developmental | ||||||
| 24 | disability, as defined in Section 1-106 of the Mental Health | ||||||
| 25 | and Developmental Disabilities Code, or a person having an | ||||||
| 26 | intellectual disability, as defined in Section 1-116 of the | ||||||
| |||||||
| |||||||
| 1 | Mental Health and Developmental Disabilities Code. | ||||||
| 2 | (2) The Illinois State Police shall complete development | ||||||
| 3 | and deployment of the Golden Search Awareness Program and | ||||||
| 4 | toolkit on or before July 1, 2026. | ||||||
| 5 | (3) The Illinois State Police shall establish a Golden | ||||||
| 6 | Search Task Force within 90 days after the effective date of | ||||||
| 7 | this amendatory Act of the 104th General Assembly to assist | ||||||
| 8 | the Illinois State Police in development and deployment of the | ||||||
| 9 | Golden Search Awareness Program and toolkit. The Task Force | ||||||
| 10 | shall establish the criteria and create a toolkit, which may | ||||||
| 11 | include usage of Department of Transportation signs, under | ||||||
| 12 | Section 2705-505.6 of the Department of Transportation Law of | ||||||
| 13 | the Civil Administrative Code of Illinois. The toolkit shall | ||||||
| 14 | include information and guidance on responding to a missing | ||||||
| 15 | person with autism spectrum disorder. The Task Force shall | ||||||
| 16 | monitor and review the implementation and operation of that | ||||||
| 17 | program, including procedures, budgetary requirements, | ||||||
| 18 | standards, and minimum requirements for the training of law | ||||||
| 19 | enforcement personnel on how to interact appropriately and | ||||||
| 20 | effectively with individuals with developmental and | ||||||
| 21 | intellectual disabilities. The Task Force shall also develop | ||||||
| 22 | additional network and financial resources for use in the | ||||||
| 23 | system. The Task Force shall include, but shall not be limited | ||||||
| 24 | to, one representative from each of the following: | ||||||
| 25 | (A) the Illinois State Police; | ||||||
| 26 | (B) the Department of Human Services; | ||||||
| |||||||
| |||||||
| 1 | (C) the Department of Public Health; | ||||||
| 2 | (D) the Illinois Guardianship and Advocacy Commission; | ||||||
| 3 | (E) the Illinois Law Enforcement Training Standards | ||||||
| 4 | Board; | ||||||
| 5 | (F) the Illinois Emergency Management Agency and | ||||||
| 6 | Office of Homeland Security; | ||||||
| 7 | (G) the Secretary of State; | ||||||
| 8 | (H) the Department of Transportation; | ||||||
| 9 | (I) the Department of the Lottery; | ||||||
| 10 | (J) the Illinois Toll Highway Authority; | ||||||
| 11 | (K) a State association dedicated to serving and | ||||||

| 20 | Search Program Coordinator in addition to the Child Safety | ||||||
| 21 | Coordinator's other duties. The Golden Search Program | ||||||
| 22 | Coordinator, in conjunction with the members of the Task | ||||||
| 23 | Force, shall assist the Illinois State Police and the Golden | ||||||
| 24 | Search Task Force in the establishment of State standards and | ||||||
| 25 | monitor the availability of federal and private funding that | ||||||
| 26 | may become available to further the objectives of the | ||||||

| 1 | Endangered Missing Person Advisory and Golden Search Awareness | ||||||
| 2 | Program. The Illinois State Police shall provide technical | ||||||

| 8 | changing Section 10.10 as follows: | ||||||

| 11 | endangered senior alert system. | ||||||
| 12 | (a) The Board shall conduct training programs for law | ||||||
| 13 | enforcement personnel of local governmental agencies in the | ||||||
| 14 | statewide coordinated child abduction alert system developed | ||||||
| 15 | under Section 2605-480 of the Illinois State Police Law of the | ||||||
| 16 | Civil Administrative Code of Illinois and the statewide | ||||||
| 17 | coordinated missing endangered senior alert system developed | ||||||
| 18 | under Section 2605-375 of the Illinois State Police Law of the | ||||||
| 19 | Civil Administrative Code of Illinois. | ||||||
| 20 | (b) The Board shall conduct a training program for law | ||||||
| 21 | enforcement personnel of local governmental agencies in the | ||||||
| 22 | statewide Alzheimer's disease, other related dementia, or | ||||||
| 23 | other dementia-like cognitive impairment coordinated Silver | ||||||
| 24 | Search Awareness Program and toolkit developed under Section | ||||||
| ||||||||||||||||||||||||||||||||||||
| ||||||||||||||||||||||||||||||||||||
| 1 | 2605-485 of the Illinois State Police Law of the Civil | |||||||||||||||||||||||||||||||||||

| 11 | statewide coordinated Golden Search Awareness Program and | |||||||||||||||||||||||||||||||||||
| 12 | toolkit developed under Section 2605-485 of the Illinois State | |||||||||||||||||||||||||||||||||||
| 13 | Police Law of the Civil Administrative Code of Illinois. The | |||||||||||||||||||||||||||||||||||
| 14 | Board shall adopt written protocols and guidelines for the | |||||||||||||||||||||||||||||||||||
| 15 | handling of missing persons cases involving a person having a | |||||||||||||||||||||||||||||||||||
| 16 | developmental disability, as defined in Section 1-106 of the | |||||||||||||||||||||||||||||||||||
| 17 | Mental Health and Developmental Disabilities Code, or a person | |||||||||||||||||||||||||||||||||||
| 18 | having an intellectual disability, as defined in Section 1-116 | |||||||||||||||||||||||||||||||||||
| 19 | of the Mental Health and Developmental Disabilities Code, | |||||||||||||||||||||||||||||||||||
| 20 | based upon protocols developed by the Golden Search Task Force | |||||||||||||||||||||||||||||||||||
| 21 | in conjunction with the Illinois State Police on or before | |||||||||||||||||||||||||||||||||||
