| 1 | | AN ACT concerning criminal law. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Criminal Code of 2012 is amended by |
| 5 | | changing Section 19-3 as follows: |
| 6 | | (720 ILCS 5/19-3) (from Ch. 38, par. 19-3) |
| 7 | | Sec. 19-3. Residential burglary. |
| 8 | | (a) A person commits residential burglary when he or she |
| 9 | | knowingly and without authority enters or knowingly and |
| 10 | | without authority remains within the dwelling place of |
| 11 | | another, or any part thereof, with the intent to commit |
| 12 | | therein a felony or theft. This offense includes the offense |
| 13 | | of burglary as defined in Section 19-1. |
| 14 | | (a-5) A person commits residential burglary when he or she |
| 15 | | falsely represents himself or herself, including but not |
| 16 | | limited to falsely representing himself or herself to be a |
| 17 | | representative of any unit of government or a construction, |
| 18 | | telecommunications, or utility company, for the purpose of |
| 19 | | gaining entry to the dwelling place of another, with the |
| 20 | | intent to commit therein a felony or theft or to facilitate the |
| 21 | | commission therein of a felony or theft by another. |
| 22 | | (a-10) A person commits residential burglary when he or |
| 23 | | she knowingly and without authority enters on the property of |
