| 2 | | AMENDMENT NO. ______. Amend Senate Bill 1559 by replacing |
| 3 | | everything after the enacting clause with the following: |
| 4 | | "Section 5. The Department of Transportation Law of the |
| 5 | | Civil Administrative Code of Illinois is amended by changing |
| 6 | | Section 2705-210 as follows: |
| 7 | | (20 ILCS 2705/2705-210) (was 20 ILCS 2705/49.15) |
| 8 | | Sec. 2705-210. Traffic control and prevention of crashes. |
| 9 | | (a) The Department has the power to develop, consolidate, |
| 10 | | and coordinate effective programs and activities for the |
| 11 | | advancement of driver education, for the facilitation of the |
| 12 | | movement of motor vehicle traffic, and for the protection and |
| 13 | | conservation of life and property on the streets and highways |
| 14 | | of this State and to advise, recommend, and consult with the |
| 15 | | several departments, divisions, boards, commissions, and other |
| 16 | | agencies of this State in regard to those programs and |

| 1 | | activities. The Department has the power to aid and assist the |
| 2 | | counties, cities, towns, and other political subdivisions of |
| 3 | | this State in the control of traffic and the prevention of |
| 4 | | traffic crashes. That aid and assistance to counties, cities, |
| 5 | | towns, and other political subdivisions of this State shall |
| 6 | | include assistance with regard to planning, traffic flow, |
| 7 | | light synchronizing, preferential lanes for carpools, and |
| 8 | | carpool parking allocations. |
| 9 | | (b) To further the prevention of crashes, the Department |
| 10 | | shall conduct a traffic study following the occurrence of any |
| 11 | | crash involving a pedestrian fatality that occurs at an |
| 12 | | intersection of a State or municipal highway. If a memorandum |
| 13 | | of understanding exists between the State and municipal |
| 14 | | departments of transportation and that memorandum of |
| 15 | | understanding requires that the 2 bodies meet monthly or |
| 16 | | regularly, the meeting agendas shall include, but not be |
| 17 | | limited to, integrated discussion of the fatality reports that |
| 18 | | each municipal or State department of transportation has |
| 19 | | conducted and how to address these crashes. Nothing in this |
| 20 | | Section limits local law enforcement or the Illinois State |
| 21 | | Police from participation. The discussion study shall include, |
| 22 | | but not be limited to, consideration of alternative geometric |
| 23 | | design improvements, traffic control devices, and any other |
| 24 | | improvements that both departments deem the Department deems |
| 25 | | necessary to reduce traffic crashes and fatalities. The |
| 26 | | Department shall make the results of the study available to |

| 1 | | the public on its website. |
| 2 | | (c) The Department shall conduct a timely analysis of each |
| 3 | | fatal traffic crash that occurs on a State or municipal |
| 4 | | highway that is reported to the Illinois State Police or a |
| 5 | | local law enforcement agency. The purpose of the analyses is |
| 6 | | to understand the circumstances associated with the traffic |
| 7 | | crashes. |
| 8 | | (d) The Department shall conduct periodic analyses to |
| 9 | | identify trends, patterns, and correlations associated with |
| 10 | | traffic crashes, including, but not limited to, trends, |
| 11 | | patterns, and correlations associated with the occurrence of |
| 12 | | fatal or serious injury traffic crash outcomes in population |
| 13 | | groups, such as pedestrians and bicyclists, or locations |
| 14 | | disproportionately impacted by fatal traffic crash outcomes. |
| 15 | | (e) Based on its analyses, the Department shall identify |
| 16 | | potential actions to increase traffic safety, which may |
| 17 | | include, but are not limited to, modifications to street |
| 18 | | design and infrastructure. When appropriate, the discussions |
| 19 | | shall include estimates for the cost of implementation and |
| 20 | | potential funding options in its identification of such |
| 21 | | potential actions. |
| 22 | | (f) In conducting analyses and in identifying potential |
| 23 | | actions, the Department shall coordinate with any other |
| 24 | | department, agency, or organization deemed relevant by the |
| 25 | | Department. |
