1    AN ACT concerning property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. Pursuant to the provisions and subject to all
5of the terms and conditions of this Act, the Director of
6Corrections, on behalf of the State of Illinois, is authorized
7to execute and deliver to the Forest Preserve District of Will
8County, Illinois, for and in consideration of $1 paid to the
9Department of Corrections, a quitclaim deed to the following
10described real property and a quitclaim bill of sale to all the
11existing tangible personal property on that real property, and
12such ancillary documents as appropriate for fully and properly
13effectuating a transfer to the Forest Preserve District of
14Will County, Illinois of the title to the land generally
15described as follows, and as may change if jointly agreed by
16the Forest Preserve District of Will County, Illinois and
17Department of Corrections as provided for in Section 25:
 
18    LOTS 1, 2, 3 AND 11 (EXCEPT THEREFROM THE E. J. & E.
19    RAILROAD) ALL IN ASSESSOR'S SUBDIVISION OF SECTION 3,
20    TOWNSHIP 35 NORTH, RANGE 10 EAST OF THE THIRD PRINCIPAL
21    MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED OCTOBER
22    28, 1861 IN BOOK 73, PAGE 464 1/2, IN WILL COUNTY,
23    ILLINOIS, EXCEPT THAT PART OF SAID LOT 1 LYING IN THE

1    181.55 FEET TO THE POINT OF BEGINNING. SAID PARCEL
2    CONTAINING 149.209 ACRES, MORE OR LESS.
 
3    Section 10. Conveyance. Upon the payment of the sum of $1
4to the Department of Corrections, and subject to the
5conditions set forth herein, the Director of Corrections, on
6behalf of the State of Illinois and the Department of
7Corrections, shall convey by quitclaim deed, quitclaim bill of
8sale, and ancillary documents all rights, title, and interest
9of the State of Illinois and the Department of Corrections in
10and to the real property described in Section 5, and all
11tangible personal property on that property, to the Forest
12Preserve District of Will County, Illinois. The Forest
13Preserve District of Will County, Illinois shall bear all
14costs associated with the conveyance and generally associated
15with the transfer.
16    The conveyance of real property and tangible personal
17property authorized by Section 5 shall be made subject to: (i)
18existing public or quasi-public utilities, existing public
19roads, and any and all reservations, easements, encumbrances,
20licenses, covenants, and restrictions of record; and (ii) the
21express condition that if said real property ceases to be used
22for public purposes, including recreation and conservation, it
23shall revert to the State of Illinois, Department of
24Corrections.
25    Each of the documents of transfer shall be subject to the

1condition that the property shall be used for public purposes
2only, including recreation and conservation, and shall so
3state on its face. Each of the documents of transfer shall
4contain an automatic reverter clause providing that title to
5the property shall revert, without further action, to the
6State of Illinois if: (i) the property is used for any purpose
7other than a public purpose; or (ii) an attempt is made to sell
8the property or convey or transfer or donate the property. If
9the property reverts to the Department of Corrections, then
10the Forest Preserve District of Will County, Illinois shall
11reimburse the Department of Corrections for legal fees to
12complete the conveyance and shall bear all other costs
13associated with the conveyance.
 
14    Section 15. Recording. The Director of Corrections shall
15obtain a certified copy of this Act within 60 days after its
16effective date. The Department of Corrections shall ensure
17that a certified copy of this Act and any quitclaim deed
18executed pursuant to this Act that is provided to the Forest
19Preserve of Will County, Illinois, shall be recorded by the
20Forest Preserve of Will County, Illinois, in the Recorder's
21Office of the county in which the land is located.
22    The transfer of title authorized under this Act shall be
23by quitclaim deed and quitclaim bill of sale, which shall be
24prepared by the Department of Corrections so that the transfer
25is on an "AS IS", "WHERE IS", and "WITH ALL FAULTS" basis as of

1the date of transfer, without any representation by the State
2of Illinois to the Forest Preserve District of Will County,
3Illinois as to the property's condition or fitness for any
4purpose. Both the deed and bill of sale shall be executed by
5the Forest Preserve District of Will County, Illinois as
6grantee in order to confirm the Forest Preserve District of
7Will County, Illinois' undertakings to abide by the
8requirements in this Act. All documents of transfer shall be
9recorded by the Forest Preserve District of Will County,
10Illinois in the county in which the property is located and a
11copy of the recordation provided to the Department of
12Corrections immediately following recordation.
 
13    Section 20. Condition for conveyance. The conveyance of
14real property authorized by Section 5 shall be made subject to
15the express conditions that the Forest Preserve District of
16Will County, Illinois shall obtain an ALTA survey describing
17the land to be transferred sufficiently and an appraisal of
18the land and shall supply a copy of the ALTA survey and
19appraisal to the Department of Corrections and the Department
20of Central Management Services for review to ensure that the
21correct land will be transferred. The conveyance of property
22authorized by Section 5 shall occur only after the Forest
23Preserve District of Will County, Illinois has provided the
24Director and the Department with the ALTA Survey accurately
25describing the land to be transferred and the appraisal.

1    Section 25. Change of legal description. If the Forest
2Preserve District of Will County, Illinois and the Department
3of Corrections jointly agree to reduce the size of the
4transfer and jointly agree on a new legal description to the
5transferred property within the boundaries described in
6Section 5, then the Director of the Department of Corrections
7is authorized to execute such documentation as provided in
8this Act with the jointly agreed upon legal description.
 
9    Section 99. Effective date. This Act takes effect July 1,
102026.
