AMENDMENT TO SENATE BILL 1698

2    AMENDMENT NO. ______. Amend Senate Bill 1698 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. Pursuant to the provisions and subject to all
5of the terms and conditions of this Act, the Director of
6Corrections, on behalf of the State of Illinois, is authorized
7to execute and deliver to the Forest Preserve District of Will
8County, Illinois, for and in consideration of $1 paid to the
9Department of Corrections, a quitclaim deed to the following
10described real property and a quitclaim bill of sale to all the
11existing tangible personal property on that real property, and
12such ancillary documents as appropriate for fully and properly
13effectuating a transfer to the Forest Preserve District of
14Will County, Illinois of the title to the land generally
15described as follows, and as may change if jointly agreed by
16the Forest Preserve District of Will County, Illinois and
17Department of Corrections as provided for in Section 25:

10    Section 10. Conveyance. Upon the payment of the sum of $1
11to the Department of Corrections, and subject to the
12conditions set forth herein, the Director of Corrections, on
13behalf of the State of Illinois and the Department of
14Corrections, shall convey by quitclaim deed, quitclaim bill of
15sale, and ancillary documents all rights, title, and interest
16of the State of Illinois and the Department of Corrections in
17and to the real property described in Section 5, and all
18tangible personal property on that property, to the Forest
19Preserve District of Will County, Illinois. The Forest
20Preserve District of Will County, Illinois shall bear all
21costs associated with the conveyance and generally associated
22with the transfer.
23    The conveyance of real property and tangible personal
24property authorized by Section 5 shall be made subject to: (i)
25existing public or quasi-public utilities, existing public

1roads, and any and all reservations, easements, encumbrances,
2licenses, covenants, and restrictions of record; and (ii) the
3express condition that if said real property ceases to be used
4for public purposes, including recreation and conservation, it
5shall revert to the State of Illinois, Department of
6Corrections.
7    Each of the documents of transfer shall be subject to the
8condition that the property shall be used for public purposes
9only, including recreation and conservation, and shall so
10state on its face. Each of the documents of transfer shall
11contain an automatic reverter clause providing that title to
12the property shall revert, without further action, to the
13State of Illinois if: (i) the property is used for any purpose
14other than a public purpose; or (ii) an attempt is made to sell
15the property or convey or transfer or donate the property. If
16the property reverts to the Department of Corrections, then
17the Forest Preserve District of Will County, Illinois shall
18reimburse the Department of Corrections for legal fees to
19complete the conveyance and shall bear all other costs
20associated with the conveyance.
 
21    Section 15. Recording. The Director of Corrections shall
22obtain a certified copy of this Act within 60 days after its
23effective date. The Department of Corrections shall ensure
24that a certified copy of this Act and any quitclaim deed
25executed pursuant to this Act that is provided to the Forest

1Preserve of Will County, Illinois, shall be recorded by the
2Forest Preserve of Will County, Illinois, in the Recorder's
3Office of the county in which the land is located.
4    The transfer of title authorized under this Act shall be
5by quitclaim deed and quitclaim bill of sale, which shall be
6prepared by the Department of Corrections so that the transfer
7is on an "AS IS", "WHERE IS", and "WITH ALL FAULTS" basis as of
8the date of transfer, without any representation by the State
9of Illinois to the Forest Preserve District of Will County,
10Illinois as to the property's condition or fitness for any
11purpose. Both the deed and bill of sale shall be executed by
12the Forest Preserve District of Will County, Illinois as
13grantee in order to confirm the Forest Preserve District of
14Will County, Illinois' undertakings to abide by the
15requirements in this Act. All documents of transfer shall be
16recorded by the Forest Preserve District of Will County,
17Illinois in the county in which the property is located and a
18copy of the recordation provided to the Department of
19Corrections immediately following recordation.
 
20    Section 20. Condition for conveyance. The conveyance of
21real property authorized by Section 5 shall be made subject to
22the express conditions that the Forest Preserve District of
23Will County, Illinois shall obtain an ALTA survey describing
24the land to be transferred sufficiently and an appraisal of
25the land and shall supply a copy of the ALTA survey and

1appraisal to the Department of Corrections and the Department
2of Central Management Services for review to ensure that the
3correct land will be transferred. The conveyance of property
4authorized by Section 5 shall occur only after the Forest
5Preserve District of Will County, Illinois has provided the
6Director and the Department with the ALTA Survey accurately
7describing the land to be transferred and the appraisal.
 
8    Section 25. Change of legal description. If the Forest
9Preserve District of Will County, Illinois and the Department
10of Corrections jointly agree to reduce the size of the
11transfer and jointly agree on a new legal description to the
12transferred property within the boundaries described in
13Section 5, then the Director of the Department of Corrections
14is authorized to execute such documentation as provided in
15this Act with the jointly agreed upon legal description.
 
16    Section 99. Effective date. This Act takes effect July 1,
172026.".
