| 3 | | everything after the enacting clause with the following: |
| 4 | | "Section 5. Pursuant to the provisions and subject to all |
| 5 | | of the terms and conditions of this Act, the Director of |
| 6 | | Corrections, on behalf of the State of Illinois, is authorized |
| 7 | | to execute and deliver to the Forest Preserve District of Will |
| 8 | | County, Illinois, for and in consideration of $1 paid to the |
| 9 | | Department of Corrections, a quitclaim deed to the following |
| 10 | | described real property and a quitclaim bill of sale to all the |
| 11 | | existing tangible personal property on that real property, and |
| 12 | | such ancillary documents as appropriate for fully and properly |
| 13 | | effectuating a transfer to the Forest Preserve District of |
| 14 | | Will County, Illinois of the title to the land generally |
| 15 | | described as follows, and as may change if jointly agreed by |
| 16 | | the Forest Preserve District of Will County, Illinois and |
| 17 | | Department of Corrections as provided for in Section 25: |

| 10 | | Section 10. Conveyance. Upon the payment of the sum of $1 |
| 11 | | to the Department of Corrections, and subject to the |
| 12 | | conditions set forth herein, the Director of Corrections, on |
| 13 | | behalf of the State of Illinois and the Department of |
| 14 | | Corrections, shall convey by quitclaim deed, quitclaim bill of |
| 15 | | sale, and ancillary documents all rights, title, and interest |
| 16 | | of the State of Illinois and the Department of Corrections in |
| 17 | | and to the real property described in Section 5, and all |
| 18 | | tangible personal property on that property, to the Forest |
| 19 | | Preserve District of Will County, Illinois. The Forest |
| 20 | | Preserve District of Will County, Illinois shall bear all |
| 21 | | costs associated with the conveyance and generally associated |
| 22 | | with the transfer. |
| 23 | | The conveyance of real property and tangible personal |
| 24 | | property authorized by Section 5 shall be made subject to: (i) |
| 25 | | existing public or quasi-public utilities, existing public |

| 1 | | roads, and any and all reservations, easements, encumbrances, |
| 2 | | licenses, covenants, and restrictions of record; and (ii) the |
| 3 | | express condition that if said real property ceases to be used |
| 4 | | for public purposes, including recreation and conservation, it |
| 5 | | shall revert to the State of Illinois, Department of |
| 6 | | Corrections. |
| 7 | | Each of the documents of transfer shall be subject to the |
| 8 | | condition that the property shall be used for public purposes |
| 9 | | only, including recreation and conservation, and shall so |
| 10 | | state on its face. Each of the documents of transfer shall |
| 11 | | contain an automatic reverter clause providing that title to |
| 12 | | the property shall revert, without further action, to the |
| 13 | | State of Illinois if: (i) the property is used for any purpose |
| 14 | | other than a public purpose; or (ii) an attempt is made to sell |
| 15 | | the property or convey or transfer or donate the property. If |
| 16 | | the property reverts to the Department of Corrections, then |
| 17 | | the Forest Preserve District of Will County, Illinois shall |
| 18 | | reimburse the Department of Corrections for legal fees to |
| 19 | | complete the conveyance and shall bear all other costs |
| 20 | | associated with the conveyance. |
| 21 | | Section 15. Recording. The Director of Corrections shall |
| 22 | | obtain a certified copy of this Act within 60 days after its |
| 23 | | effective date. The Department of Corrections shall ensure |
| 24 | | that a certified copy of this Act and any quitclaim deed |
| 25 | | executed pursuant to this Act that is provided to the Forest |

| 1 | | Preserve of Will County, Illinois, shall be recorded by the |
| 2 | | Forest Preserve of Will County, Illinois, in the Recorder's |
| 3 | | Office of the county in which the land is located. |
| 4 | | The transfer of title authorized under this Act shall be |
| 5 | | by quitclaim deed and quitclaim bill of sale, which shall be |
| 6 | | prepared by the Department of Corrections so that the transfer |
| 7 | | is on an "AS IS", "WHERE IS", and "WITH ALL FAULTS" basis as of |
| 8 | | the date of transfer, without any representation by the State |
| 9 | | of Illinois to the Forest Preserve District of Will County, |
| 10 | | Illinois as to the property's condition or fitness for any |
| 11 | | purpose. Both the deed and bill of sale shall be executed by |
| 12 | | the Forest Preserve District of Will County, Illinois as |
| 13 | | grantee in order to confirm the Forest Preserve District of |
| 14 | | Will County, Illinois' undertakings to abide by the |
| 15 | | requirements in this Act. All documents of transfer shall be |
| 16 | | recorded by the Forest Preserve District of Will County, |
| 17 | | Illinois in the county in which the property is located and a |
| 18 | | copy of the recordation provided to the Department of |
| 19 | | Corrections immediately following recordation. |
| 20 | | Section 20. Condition for conveyance. The conveyance of |
| 21 | | real property authorized by Section 5 shall be made subject to |
| 22 | | the express conditions that the Forest Preserve District of |
| 23 | | Will County, Illinois shall obtain an ALTA survey describing |
| 24 | | the land to be transferred sufficiently and an appraisal of |
| 25 | | the land and shall supply a copy of the ALTA survey and |
|

| 1 | | appraisal to the Department of Corrections and the Department |
| 2 | | of Central Management Services for review to ensure that the |
| 3 | | correct land will be transferred. The conveyance of property |
| 4 | | authorized by Section 5 shall occur only after the Forest |
| 5 | | Preserve District of Will County, Illinois has provided the |
| 6 | | Director and the Department with the ALTA Survey accurately |
| 7 | | describing the land to be transferred and the appraisal. |
| 8 | | Section 25. Change of legal description. If the Forest |
| 9 | | Preserve District of Will County, Illinois and the Department |
| 10 | | of Corrections jointly agree to reduce the size of the |
| 11 | | transfer and jointly agree on a new legal description to the |
| 12 | | transferred property within the boundaries described in |
| 13 | | Section 5, then the Director of the Department of Corrections |
| 14 | | is authorized to execute such documentation as provided in |
| 15 | | this Act with the jointly agreed upon legal description. |
| 16 | | Section 99. Effective date. This Act takes effect July 1, |
| 17 | | 2026.". |
