AMENDMENT TO SENATE BILL 1911

2    AMENDMENT NO. ______. Amend Senate Bill 1911, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41, on page 189, immediately below line 5, by inserting the
5following:
 
6    "Section 20. The Sports Wagering Act is amended by
7changing Section 25-110 and by adding Section 25-115 as
8follows:
 
9    (230 ILCS 45/25-110)
10    Sec. 25-110. Preemption. Except as provided in Section
1125-115, nothing Nothing in this Act shall be deemed to
12diminish the rights, privileges, or remedies of a person under
13any other federal or State law, rule, or regulation.

1    Sec. 25-115. Home rule.
2    (a) The regulation and licensing of sports wagering,
3including, but not limited to, the imposition of fees,
4surcharges, or other costs for the privilege of conducting or
5participating in sports wagering, are exclusive powers and
6functions of the State. A home rule unit may not regulate or
7license sports wagering. This subsection (a) is a denial and
8limitation of home rule powers and functions under subsection
9(h) of Section 6 of Article VII of the Illinois Constitution.
10    (b) A home rule unit may not impose or collect a tax on
11sports wagering or a tax on receipts generated from sports
12wagering. This subsection (b) is a denial and limitation of
13home rule powers and functions under subsection (g) of Section
146 of Article VII of the Illinois Constitution.".
