SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1433 new

    Amends the Illinois Vehicle Code. Provides that if a person is convicted of running a red light, disobeying a stop sign, failing to obey a yield sign, or disobeying or avoiding a traffic control device and such action is determined to be the approximate cause of seriously bodily harm or death to another person, the person shall be subject to a fine of no less than $1,000 and no more than $5,000. Provides that when assessing the amount of the fine, the judge may take into account mitigating factors, including, but not limited to, acceptance of responsibility by the defendant, if any restitution or insurance was paid to the victim, whether the defendant poses a risk to public safety, undue hardship, total fault of each party, and any other mitigating factors the judge deems necessary.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 11-1433 as follows:
 
6    (625 ILCS 5/11-1433 new)
7    Sec. 11-1433. Penalties for specific violations.
8    (a) If a person is convicted of violating Section 11-305,
911-306, or 11-1204 and such violation is determined to be the
10approximate cause of seriously bodily harm or death to another
11person, the person shall be subject to a fine of no less than
12$1,000 and no more than $5,000.
13    (b) When assessing the amount of a fine under this
14Section, the judge, in the judge's discretion, may take into
15account mitigating factors, including, but not limited to,
16acceptance of responsibility by the defendant, if any
17restitution or insurance was paid to the victim, whether the
18defendant poses a risk to public safety, undue hardship, total
19fault of each party, and any other mitigating factors the
20judge deems necessary.
