AMENDMENT TO SENATE BILL 2713

2    AMENDMENT NO. ______. Amend Senate Bill 2713, AS AMENDED,
3with reference to page and line numbers of Senate Amendment
4No. 1, on page 36, line 18, by replacing "5" with "5, 15,"; and
 
5on page 39, immediately below line 11, by inserting the
6following:
 
7    "(210 ILCS 160/15)
8    Sec. 15. Workplace safety.
9    (a) A health care worker who contacts law enforcement or
10files a report with law enforcement against a patient or
11individual because of workplace violence shall provide notice
12to management of the health care provider by which he or she is
13employed within 3 days after contacting law enforcement or
14filing the report.
15    (b) No management of a health care provider may discourage
16a health care worker from exercising his or her right to

1contact law enforcement or the Department or file a report
2with law enforcement because of workplace violence.
3    (c) A health care provider that employs a health care
4worker shall display a notice, either by physical or
5electronic means, stating that verbal aggression will not be
6tolerated and physical assault will be reported to law
7enforcement.
8    (d) The health care provider shall offer immediate
9post-incident services for a health care worker directly
10involved in a workplace violence incident caused by patients
11or their visitors, including acute treatment and access to
12psychological evaluation.
13    (e) No health care provider may maintain a policy that
14limits the type of workplace violence about which a health
15care worker may contact law enforcement or file a report with
16law enforcement or the Department.
