2025 and 2026 SB2739 Introduced 1/13/2026, by Sen. Julie A. Morrison SYNOPSIS AS INTRODUCED: | | | Amends the Hospital Licensing Act. Grants the Department of Public Health independent authority to investigate all complaints alleging violations of the Act. Provides that, if the Department conducts a federal complaint survey, it shall independently determine if the survey also addresses violations of State law, and when a federal complaint survey is not authorized, either in whole or in part, the Department shall initiate an independent investigation into violations of State law within 30 calendar days after completion of the federal survey. Requires the Department to promptly initiate, within 30 days after the date the Department receives the result of any federal complaint survey, an independent investigation of the violations of the Act in all other cases in which any alleged violations of the Act are not part of a federal complaint survey. Requires the Department to submit annual reports to the General Assembly on or before December 31 each year on specified investigations of alleged violations of State law. Provides that the report shall include a summary of all completed investigations, actions taken, and recommendations for improvements. |

| 1 | | AN ACT concerning regulation. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Hospital Licensing Act is amended by adding |
| 5 | | Section 9.01 as follows: |
| 6 | | (210 ILCS 85/9.01 new) |
| 7 | | Sec. 9.01. Federal complaint survey oversight. |
| 8 | | (a) For purposes of this Section: |
| 9 | | "Completion of the federal complaint survey" means the |
| 10 | | date on which the Department has completed the federal |
| 11 | | complaint survey report. |
| 12 | | "Initiate an independent investigation" means the |
| 13 | | commencement of investigative activities, including, but not |
| 14 | | limited to, site visits, interviews, document and record |
| 15 | | reviews, and other fact-finding actions. |
| 16 | | "Violations of this Act" include, but are not limited to, |
| 17 | | patient abuse as defined in subsection (t) of Section 9.6; |
| 18 | | improper hospital discharge procedures; the failure to comply |
| 19 | | with required hospital operational licenses; the failure to |
| 20 | | maintain patient safety standards; and other acts or omissions |
| 21 | | that violate the provisions or purpose of this Act. |
| 22 | | (b) The Department has independent authority to |
| 23 | | investigate all complaints alleging violations of this Act. |
