SYNOPSIS AS INTRODUCED:

    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Instructs the Department of Public Health to require a health care practitioner who is treating a patient diagnosed with epilepsy and at elevated risk for sudden unexpected death in epilepsy and who has primary responsibility for the treatment and care of the patient for epilepsy, other than a health care practitioner treating that patient in an emergency situation, to provide that patient with certain written information regarding sudden unexpected death in epilepsy. Requires the Department to provide that written information to health care practitioners and post the information on the Department's website. Requires the Department to ensure that the information is culturally and linguistically appropriate for all recipients. Allows a local or national organization that provides education or services related to epilepsy conditions to request that the Department include on its website the organization's informational material and contact information. Requires the Department to provide guidance to health care practitioners in determining whether a patient is at elevated risk for sudden unexpected death in epilepsy. Requires the Department to adopt rules. Amends the Medical Practice Act of 1987, the Nurse Practice Act, and the Physician Assistance Practice Act to require licensees under the Acts to comply with the amendatory provisions in the Department of Public Health Powers and Duties Law. Provides that certain licensees under the Acts who violate the amendatory provisions shall be issued a warning by the Department of Financial and Professional Regulation and shall suffer no further penalty or discipline for a first offense if the violation was not committed willfully or knowingly. Provides that certain licensees under the Acts who commit a subsequent violation of the amendatory provisions shall pay a civil penalty, as determined by the Department of Financial and Professional Regulation, of no more than $10,000 to the Department of Financial and Professional Regulation for each subsequent violation. Makes other changes.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-750 as follows:
 
7    (20 ILCS 2310/2310-750 new)
8    Sec. 2310-750. Sudden unexpected death in epilepsy.
9    (a) In this Section:
10    "Health care practitioner" means a physician, an advanced
11practice registered nurse, or a physician assistant licensed
12or certified in this State.
13    "Sudden unexpected death in epilepsy" means sudden,
14unexpected death in a patient with epilepsy, with or without
15evidence of a seizure.
16    (b) The Department shall adopt rules requiring a health
17care practitioner who is treating a patient diagnosed with
18epilepsy and at elevated risk for sudden unexpected death in
19epilepsy and who has primary responsibility for the treatment
20and care of the patient for epilepsy, other than a health care
21practitioner treating that patient in an emergency situation,
22to provide that patient with the following written
23information:

1        (1) current and evidence-based information about
2    sudden unexpected death in epilepsy risk factors and
3    conditions reviewed and approved by one or more
4    professional not-for-profit organizations with expertise
5    in neurology and epilepsy; and
6        (2) contact information for nonprofit organizations
7    that provide information and support services for epilepsy
8    conditions.
9    (c) The Department shall provide written information to
10health care practitioners necessary to implement the
11requirements of the rules the Department adopts under this
12Section and shall also post that information on the
13Department's website, with the following requirements:
14        (1) the Department shall ensure that the information
15    under this Section is culturally and linguistically
16    appropriate for all recipients;
17        (2) any local or national organization that provides
18    education or services related to epilepsy conditions may
19    request that the Department include on its website that
20    organization's informational material and contact
21    information; if the Department determines that the
22    organization's informational material, contact
23    information, or both are necessary or appropriate under
24    this Section, the Department may include the
25    organization's informational material, contact
26    information, or both on its website, in written

1    information provided under this subsection (c), or both;
2    and
3        (3) the Department shall, in consultation with local
4    and national organizations that provide education or
5    services related to epilepsy conditions, provide guidance
6    to health care practitioners in determining whether a
7    patient is at elevated risk for sudden unexpected death in
8    epilepsy, including, but not limited to, whether the
9    patient has had convulsive seizures, the frequency and
10    recency of such seizures, and whether the patient's
11    symptoms have subsided in response to medicinal or
12    surgical treatment.
13    (d) The Department shall adopt rules implementing this
14Section.
 
15    Section 10. The Medical Practice Act of 1987 is amended by
16adding Section 67 as follows:
 
17    (225 ILCS 60/67 new)
18    Sec. 67. Sudden unexpected death in epilepsy; violations
19and enforcement.
20    (a) A licensee under this Act shall comply with Section
212310-750 of the Department of Public Health Powers and Duties
22Law of the Civil Administrative Code of Illinois and the rules
23adopted thereunder.
24    (b) A licensee who violates this Section shall be issued a

1warning by the Department and shall suffer no further penalty
2or discipline for a first offense if the violation was not
3committed willfully or knowingly. A licensee who commits a
4subsequent violation of this Section shall pay a civil
5penalty, as determined by the Department, of no more than
6$10,000 to the Department for each subsequent violation. The
7civil penalty shall be assessed by the Department after a
8hearing is held in accordance with the provisions set forth in
9this Act regarding the provision of a hearing for the
10discipline of a licensee.
11    (c) A civil penalty required under this Section shall be
12paid within 60 days after the effective date of the order
13imposing the civil penalty. The order shall constitute a
14judgment and may be filed, and execution had thereon, in the
15same manner as any judgment from any court of record.
 
16    Section 15. The Nurse Practice Act is amended by adding
17Section 65-75 as follows:
 
18    (225 ILCS 65/65-75 new)
19    Sec. 65-75. Sudden unexpected death in epilepsy;
20violations and enforcement.
21    (a) An advanced practice registered nurse licensed under
22this Act shall comply with Section 2310-750 of the Department
23of Public Health Powers and Duties Law of the Civil
24Administrative Code of Illinois and the rules adopted

1thereunder.
2    (b) An advanced practice registered nurse licensed under
3this Act who violates this Section shall be issued a warning by
4the Department and shall suffer no further penalty or
5discipline for a first offense if the violation was not
6committed willfully or knowingly. An advanced practice
7registered nurse licensed under this Act who commits a
8subsequent violation of this Section shall pay a civil
9penalty, as determined by the Department, of no more than
10$10,000 to the Department for each subsequent violation.
11    (c) A civil penalty required under this Section shall be
12paid within 60 days after the effective date of the order
13imposing the civil penalty. The order shall constitute a
14judgment and may be filed, and execution had thereon, in the
15same manner as any judgment from any court of record.
 
16    Section 20. The Physician Assistant Practice Act of 1987
17is amended by adding Section 21.6 as follows:

19    Sec. 21.6. Sudden unexpected death in epilepsy; violations
20and enforcement.
21    (a) A licensee under this Act shall comply with Section
222310-750 of the Department of Public Health Powers and Duties
23Law of the Civil Administrative Code of Illinois and the rules
24adopted thereunder.
