AMENDMENT TO SENATE BILL 2806

2    AMENDMENT NO. ______. Amend Senate Bill 2806, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Private Detective, Private Alarm, Private
6Security, Fingerprint Vendor, and Locksmith Act of 2004 is
7amended by changing Section 50-10 as follows:
 
8    (225 ILCS 447/50-10)
9    (Section scheduled to be repealed on January 1, 2029)
10    Sec. 50-10. The Private Detective, Private Alarm, Private
11Security, Fingerprint Vendor, and Locksmith Board.
12    (a) The Private Detective, Private Alarm, Private
13Security, Fingerprint Vendor, and Locksmith Board shall
14consist of 11 13 members appointed by the Secretary and
15comprised of 2 licensed private detectives, 3 licensed private
16security contractors, one licensed private detective or

1licensed private security contractor who provides canine odor
2detection services, 2 licensed private alarm contractors, one
3licensed fingerprint vendor, one 2 licensed locksmith
4locksmiths, one public member who is not licensed or
5registered under this Act and who has no connection with a
6business licensed under this Act, and one member representing
7the employees registered under this Act. Each member shall be
8a resident of Illinois. Each licensed member shall have at
9least 3 years' 5 years experience as a licensee in the
10professional area in which the person is licensed and be in
11good standing and actively engaged in that profession. In
12making appointments, the Secretary shall consider the
13recommendations of the professionals and the professional
14organizations representing the licensees. The membership shall
15reasonably reflect the different geographic areas in Illinois.
16    (b) Members shall serve 4-year terms and may serve until
17their successors are appointed. No member shall serve for more
18than 2 successive terms. Appointments to fill vacancies shall
19be made in the same manner as the original appointments for the
20unexpired portion of the vacated term.
21    (c) A member of the Board may be removed for cause. A
22member subject to formal disciplinary proceedings shall
23disqualify oneself from all Board business until the charge is
24resolved. A member also shall disqualify oneself from any
25matter on which the member cannot act objectively.
26    (d) Members shall receive compensation as set by law. Each

1member shall receive reimbursement as set by the Governor's
2Travel Control Board for expenses incurred in carrying out the
3duties as a Board member.
4    (e) A majority of appointed Board members constitutes a
5quorum. A majority vote of the quorum is required for a
6decision.
7    (f) The Board shall elect a chairperson and vice
8chairperson annually.
9    (g) Board members are not liable for their acts,
10omissions, decisions, or other conduct in connection with
11their duties on the Board, except those determined to be
12willful, wanton, or intentional misconduct.
13    (h) The Board may recommend policies, procedures, and
14rules relevant to the administration and enforcement of this
15Act.
