AMENDMENT TO SENATE BILL 2858

2    AMENDMENT NO. ______. Amend Senate Bill 2858 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 3-421 as follows:
 
6    (625 ILCS 5/3-421)  (from Ch. 95 1/2, par. 3-421)
7    Sec. 3-421. Right of reassignment.
8    (a) Every natural person shall have the right of
9reassignment of the license number issued to him during the
10current registration plate or digital registration plate term,
11for the ensuing registration plate or digital registration
12plate term, provided his or her application for reassignment
13is received in the Office of the Secretary of State on or
14before September 30 of the final year of the registration
15plate or digital registration plate term as to a vehicle
16registered on a calendar year, and on or before March 31 as to

1a vehicle registered on a fiscal year. The right of
2reassignment shall apply to every natural person under the
3staggered registration system provided the application for
4reassignment is received in the Office of the Secretary of
5State by the 1st day of the month immediately preceding the
6applicant's month of expiration.
7    In addition, every natural person shall have the right of
8reassignment of the license number issued to him for a
9two-year registration, for the ensuing two-year period. Where
10the two-year period is for two calendar years, the application
11for reassignment must be received by the Secretary of State on
12or before September 30th of the year preceding commencement of
13the two-year period. Where the two-year period is for two
14fiscal years commencing on July 1, the application for
15reassignment must be received by the Secretary of State on or
16before April 30th immediately preceding commencement of the
17two-year period.
18    The right of reassignment authorized under this Section
19shall include the transfer of registration plates from one
20vehicle owner to another vehicle owner, as long as the
21transferor and transferee of such plates complete all forms
22and submit all applicable fees as required by the Secretary of
23State and this Code for the transfer of registration to a
24vehicle that is titled in the name of the transferee. However,
25the transfer authorized under this paragraph shall not apply
26to registration plates which, by their nature, the transferee

1would not be eligible to receive.
2    (b) Notwithstanding the above provision, the Secretary of
3State shall, subject to the existing right of reassignment,
4have the authority to designate new specific combinations of
5numerical, alpha-numerical, and numerical-alpha licenses for
6vehicles registered on a calendar year or on a fiscal year,
7whether the license be issued for one or more years. The new
8combinations so specified shall not be subject to the right of
9reassignment, and no right of reassignment thereto may at any
10future time be acquired.
11    (c) If a person has a registration plate in his or her name
12and seeks to reassign the registration plate to his or her
13spouse, the Secretary shall waive any transfer fee or vanity
14or personalized registration plate fee upon both spouses
15signing a form authorizing the reassignment of registration.
16    (c-1) If a person who has a registration plate in his or
17her name seeks to reassign the registration plate to his or her
18child, the Secretary shall waive any transfer fee or vanity or
19personalized registration plate fee.
