AMENDMENT TO SENATE BILL 2858

2    AMENDMENT NO. ______. Amend Senate Bill 2858, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Vehicle Code is amended by
6changing Section 3-421 as follows:
 
7    (625 ILCS 5/3-421)  (from Ch. 95 1/2, par. 3-421)
8    Sec. 3-421. Right of reassignment.
9    (a) Every natural person shall have the right of
10reassignment of the license number issued to him during the
11current registration plate or digital registration plate term,
12for the ensuing registration plate or digital registration
13plate term, provided his or her application for reassignment
14is received in the Office of the Secretary of State on or
15before September 30 of the final year of the registration
16plate or digital registration plate term as to a vehicle

1registered on a calendar year, and on or before March 31 as to
2a vehicle registered on a fiscal year. The right of
3reassignment shall apply to every natural person under the
4staggered registration system provided the application for
5reassignment is received in the Office of the Secretary of
6State by the 1st day of the month immediately preceding the
7applicant's month of expiration.
8    In addition, every natural person shall have the right of
9reassignment of the license number issued to him for a
10two-year registration, for the ensuing two-year period. Where
11the two-year period is for two calendar years, the application
12for reassignment must be received by the Secretary of State on
13or before September 30th of the year preceding commencement of
14the two-year period. Where the two-year period is for two
15fiscal years commencing on July 1, the application for
16reassignment must be received by the Secretary of State on or
17before April 30th immediately preceding commencement of the
18two-year period.
19    The right of reassignment authorized under this Section
20shall include the transfer of registration plates from one
21vehicle owner to another vehicle owner, as long as the
22transferor and transferee of such plates complete all forms
23and submit all applicable fees as required by the Secretary of
24State and this Code for the transfer of registration to a
25vehicle that is titled in the name of the transferee. However,
26the transfer authorized under this paragraph shall not apply

1to registration plates which, by their nature, the transferee
2would not be eligible to receive. No vehicle owner may
3transfer registration plates under this paragraph by selling
4the license number issued to the vehicle owner.
5    (b) Notwithstanding the above provision, the Secretary of
6State shall, subject to the existing right of reassignment,
7have the authority to designate new specific combinations of
8numerical, alpha-numerical, and numerical-alpha licenses for
9vehicles registered on a calendar year or on a fiscal year,
10whether the license be issued for one or more years. The new
11combinations so specified shall not be subject to the right of
12reassignment, and no right of reassignment thereto may at any
13future time be acquired.
14    (c) If a person has a registration plate in his or her name
15and seeks to reassign the registration plate to his or her
16spouse, the Secretary shall waive any transfer fee or vanity
17or personalized registration plate fee upon both spouses
18signing a form authorizing the reassignment of registration.
19    (c-1) If a person who has a registration plate in his or
20her name seeks to reassign the registration plate to his or her
21child, the Secretary shall waive any transfer fee or vanity or
22personalized registration plate fee.
