| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2858, AS AMENDED, |
| 3 | | by replacing everything after the enacting clause with the |
| 4 | | following: |
| 5 | | "Section 5. The Illinois Vehicle Code is amended by |
| 6 | | changing Section 3-421 as follows: |
| 7 | | (625 ILCS 5/3-421) (from Ch. 95 1/2, par. 3-421) |
| 8 | | Sec. 3-421. Right of reassignment. |
| 9 | | (a) Every natural person shall have the right of |
| 10 | | reassignment of the license number issued to him during the |
| 11 | | current registration plate or digital registration plate term, |
| 12 | | for the ensuing registration plate or digital registration |
| 13 | | plate term, provided his or her application for reassignment |
| 14 | | is received in the Office of the Secretary of State on or |
| 15 | | before September 30 of the final year of the registration |
| 16 | | plate or digital registration plate term as to a vehicle |

| 1 | | registered on a calendar year, and on or before March 31 as to |
| 2 | | a vehicle registered on a fiscal year. The right of |
| 3 | | reassignment shall apply to every natural person under the |
| 4 | | staggered registration system provided the application for |
| 5 | | reassignment is received in the Office of the Secretary of |
| 6 | | State by the 1st day of the month immediately preceding the |
| 7 | | applicant's month of expiration. |
| 8 | | In addition, every natural person shall have the right of |
| 9 | | reassignment of the license number issued to him for a |
| 10 | | two-year registration, for the ensuing two-year period. Where |
| 11 | | the two-year period is for two calendar years, the application |
| 12 | | for reassignment must be received by the Secretary of State on |
| 13 | | or before September 30th of the year preceding commencement of |
| 14 | | the two-year period. Where the two-year period is for two |
| 15 | | fiscal years commencing on July 1, the application for |
| 16 | | reassignment must be received by the Secretary of State on or |
| 17 | | before April 30th immediately preceding commencement of the |
| 18 | | two-year period. |
| 19 | | The right of reassignment authorized under this Section |
| 20 | | shall include the transfer of registration plates from one |
| 21 | | vehicle owner to another vehicle owner, as long as the |
| 22 | | transferor and transferee of such plates complete all forms |
| 23 | | and submit all applicable fees as required by the Secretary of |
| 24 | | State and this Code for the transfer of registration to a |
| 25 | | vehicle that is titled in the name of the transferee. However, |
| 26 | | the transfer authorized under this paragraph shall not apply |

| 1 | | to registration plates which, by their nature, the transferee |
| 2 | | would not be eligible to receive. No vehicle owner may |
| 3 | | transfer registration plates under this paragraph by selling |
| 4 | | the license number issued to the vehicle owner. |
| 5 | | (b) Notwithstanding the above provision, the Secretary of |
| 6 | | State shall, subject to the existing right of reassignment, |
| 7 | | have the authority to designate new specific combinations of |
| 8 | | numerical, alpha-numerical, and numerical-alpha licenses for |
| 9 | | vehicles registered on a calendar year or on a fiscal year, |
| 10 | | whether the license be issued for one or more years. The new |
| 11 | | combinations so specified shall not be subject to the right of |
| 12 | | reassignment, and no right of reassignment thereto may at any |
| 13 | | future time be acquired. |
| 14 | | (c) If a person has a registration plate in his or her name |
| 15 | | and seeks to reassign the registration plate to his or her |
| 16 | | spouse, the Secretary shall waive any transfer fee or vanity |
| 17 | | or personalized registration plate fee upon both spouses |
| 18 | | signing a form authorizing the reassignment of registration. |
| 19 | | (c-1) If a person who has a registration plate in his or |
| 20 | | her name seeks to reassign the registration plate to his or her |
| 21 | | child, the Secretary shall waive any transfer fee or vanity or |
| 22 | | personalized registration plate fee. |
