SYNOPSIS AS INTRODUCED:

    Amends the Animal Welfare Act. Provides that an animal shelter or animal control facility shall not adopt out any dog or adopt out or return to field any cat unless it has been sterilized and microchipped and the adopted dog's or cat's microchip has been registered in a national database with the adoptive owner's information within 7 days after the date of adoption of the dog or cat. Provides that, if an adopted dog or cat comes into the possession of an animal control facility, a law enforcement agency, another animal shelter, or a veterinarian at any time after the adoption of the animal and the facility, agency, shelter, or veterinarian requests information pertaining to the identity and whereabouts of the animal's adopter or the history of the animal, the agency from which the animal was adopted shall provide the information to the requesting facility, agency, shelter, or veterinarian immediately. Provides that an animal shelter or animal control facility must provide to the adopter prior to the time of adoption the following information, to the best of its knowledge, on any dog or cat being offered for adoption: if the dog or cat has bitten or scratched any person; and, for a dog, (i) any behavior noted during interactions with the dog, including during intake, walks, play groups, socialization sessions, medical examinations, and other assessments; (ii) if the dog has killed a companion animal or livestock; and (iii) if the dog has been deemed vicious or dangerous pursuant to the Animal Control Act. Provides that an animal shelter or animal control facility shall not offer for adoption, give away, re-home, or place in a location any dog that has been deemed vicious or dangerous under the Animal Control Act. Removes the requirement that an animal shelter or animal control facility post in a conspicuous place in writing on or near the cage of any dog or cat available for adoption the information required by the provisions concerning adoption.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Animal Welfare Act is amended by changing
5Sections 3.3 and 3.5 as follows:
 
6    (225 ILCS 605/3.3)
7    Sec. 3.3. Adoption of dogs and cats.
8    (a) An animal shelter or animal control facility shall not
9adopt out any dog or adopt out or return to field any cat
10unless it has been sterilized and microchipped and the adopted
11dog's or cat's microchip has been registered in a national
12database with the adoptive owner's information within 7 days
13after the date of adoption of the dog or cat. However, an
14animal shelter or animal control facility may adopt out a dog
15or cat that has not been sterilized and microchipped if the
16adopting owner has executed a written agreement to have
17sterilizing and microchipping procedures performed within 14
18days after a licensed veterinarian certifies the dog or cat is
19healthy enough for sterilizing and microchipping procedures
20and a licensed veterinarian has certified that the dog or cat
21is too sick or injured to be sterilized or it would be
22detrimental to the health of the dog or cat to be sterilized or
23microchipped at the time of the adoption.

1    (b) An animal shelter or animal control facility may adopt
2out any dog or cat that is not free of disease, injury, or
3abnormality if the disease, injury, or abnormality is
4disclosed in writing to the adopter, and the animal shelter or
5animal control facility allows the adopter to return the
6animal to the animal shelter or animal control facility.
7    (c) The requirements of subsections (a) and (b) of this
8Section do not apply to adoptions subject to Section 11 of the
9Animal Control Act.
10    (d) An animal shelter or animal control facility may waive
11the adoption fee for a dog or cat if the person adopting the
12dog or cat:
13        (1) presents to the animal shelter or animal control
14    facility a current and valid Illinois driver's license
15    with the word "veteran" printed on its face, a current and
16    valid Illinois Identification Card with the word "veteran"
17    printed on its face, or an identification card issued
18    under the federal Veterans Identification Card Act of 2015
19    and a valid Illinois driver's license or valid Illinois
20    Identification Card; and
21        (2) complies with the adoption policies of the animal
22    shelter or animal control facility.
23    (e) An animal shelter or animal control facility may limit
24the number of dogs or cats adopted from that animal shelter or
25animal control facility pursuant to this Section to one dog or
26cat each in a 2-year period.

1    (f) If an adopted dog or cat comes into the possession of
2an animal control facility, a law enforcement agency, another
3animal shelter, or a veterinarian at any time after the
4adoption of the animal and the facility, agency, shelter, or
5veterinarian requests information pertaining to the identity
6and whereabouts of the animal's adopter or the history of the
7animal, the agency from which the animal was adopted shall
8provide the information to the requesting facility, agency,
9shelter, or veterinarian immediately.

13    Sec. 3.5. Information on dogs and cats available for
14adoption by an animal shelter or animal control facility.
15    (a) An animal shelter or animal control facility must
16provide to the adopter prior to the time of adoption the
17following information, to the best of its knowledge, on any
18dog or cat being offered for adoption:
19        (1) The breed, age, date of birth, sex, and color of
20    the dog or cat if known, or if unknown, the animal shelter
21    or animal control facility shall estimate to the best of
22    its ability.
23        (2) The details of any inoculation or medical
24    treatment that the dog or cat received while under the
25    possession of the animal shelter or animal control

1    facility.
2        (3) The adoption fee and any additional fees or
3    charges.
4        (4) If the dog or cat was returned by an adopter, then
5    the date and reason for the return.
6        (5) The following written statement: "A copy of our
7    policy regarding warranties, refunds, or returns is
8    available upon request.".
9        (6) The license number of the animal shelter or animal
10    control facility issued by the Illinois Department of
11    Agriculture.
12        (7) If the dog or cat has bitten or scratched any
13    person.
14        (8) For a dog, the following items:
15            (i) any behavior noted during interactions with
16        the dog, including during intake, walks, play groups,
17        socialization sessions, medical examinations, and
18        other assessments;
19            (ii) if the dog has killed a companion animal or
20        livestock; and
21            (iii) if the dog has been deemed vicious or
22        dangerous pursuant to Sections 15 and 15.1 of the
23        Animal Control Act.
24    (b) The information required in subsection (a) shall be
25provided to the adopter in written form by the animal shelter
26or animal control facility and shall have an acknowledgement

1of disclosures form, which must be signed by the adopter and an
2authorized representative of the animal shelter or animal
3control facility at the time of the adoption. The
4acknowledgement of disclosures form shall include the
5following:
6        (1) A blank space for the dated signature and printed
7    name of the authorized representative handling the
8    adoption on behalf of the animal shelter or animal control
9    facility, which shall be immediately beneath the following
10    printed statement: "I hereby attest that all of the above
11    information is true and correct to the best of my
12    knowledge.".
13        (2) A blank space for the dated signature and printed
14    name of the adopter, which shall be immediately beneath
15    the following statement: "I hereby attest that this
16    disclosure was posted on or near the cage of the dog or cat
17    for adoption and that I have read all the disclosures. I
18    further understand that I am entitled to keep a signed
19    copy of this disclosure.".
20    (c) A copy of the disclosures and the signed
21acknowledgement of disclosures form shall be provided to the
22adopter and the original copy shall be maintained by the
23animal shelter or animal control facility for a period of 2
24years from the date of adoption. A copy of the animal shelter's
25or animal control facility's policy regarding warranties,
26refunds, or returns shall be provided to the adopter.

1    (d) (Blank). An animal shelter or animal control facility
2shall post in a conspicuous place in writing on or near the
3cage of any dog or cat available for adoption the information
4required by subsection (a) of this Section 3.5.
5    (e) An animal shelter or animal control facility shall not
6offer for adoption, give away, re-home, or place in a location
7any dog that has been deemed vicious under Section 15 of the
8Animal Control Act or deemed dangerous under Section 15.1 of
9the Animal Control Act.
