1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Adoption Act is amended by changing Section
518.4 as follows:
 
6    (750 ILCS 50/18.4)  (from Ch. 40, par. 1522.4)
7    Sec. 18.4. Information provided to adoptive parents. (a)
8The agency, Department of Children and Family Services, Court
9Supportive Services, Juvenile Division of the Circuit Court,
10or the Probation Officers of the Circuit Court involved in the
11adoption proceedings shall give in writing the following
12non-identifying information, if known, to the adoptive parents
13not later than the date of placement with the petitioning
14adoptive parents: (i) age of biological parents; (ii) their
15race, religion and ethnic background; (iii) general physical
16appearance of biological parents; (iv) their education,
17occupation, hobbies, interests and talents; (v) existence of
18any other children born to the biological parents; (vi)
19information about biological grandparents; reason for
20emigrating into the United States, if applicable, and country
21of origin; (vii) relationship between biological parents;
22(viii) detailed medical and mental health histories of the
23child, the biological parents, and their immediate relatives;

1(ix) the actual date and place of birth of the adopted person;
2and (x) the reason or reasons the birth parent or parents
3stated for placing the child for adoption, how and why the
4adoptive parent or parents were selected and who selected the
5adoptive parent or parents, and whether the birth parent or
6parents requested or agreed to post-adoption contact with the
7child at the time of placement, and, if so, the frequency and
8type of contact; and (xi) whether the child was placed in
9foster care before adoption, and if so, available information
10about significant developmental milestones observed or
11documented that occurred while the child was placed under the
12custody and guardianship of the Department. This information
13may include, but is not limited to, the child's first steps,
14first words, toilet training, and other notable developmental
15progress. However, no information provided under this
16subsection shall disclose the name or last known address of
17the biological parents, grandparents, the siblings of the
18biological parents, the adopted person, or any other relative
19of the adopted person. Disclosure under this subsection is
20subject to applicable State or federal confidentiality laws.
21On or before January 1, 2027, the Department of Children and
22Family Services shall adopt any rules necessary to implement
23the changes made to this subsection by this amendatory Act of
24the 104th General Assembly.
25    (b) Any adoptee 18 years of age or over shall be given the
26information in subsection (a) upon request.

1    (c) The Illinois Adoption Registry shall release any
2non-identifying information listed in (a) of this Section that
3appears on the certified copy of the original birth
4certificate or the Certificate of Adoption to an adopted
5person, adoptive parent, or legal guardian who is a registrant
6of the Illinois Adoption Registry.
7    (d) The Illinois Adoption Registry shall release the
8actual date and place of birth of an adopted person who is 21
9years of age or over to the birth parent if the birth parent is
10a registrant of the Illinois Adoption Registry and has
11completed a Medical Information Exchange Authorization.
12    (e) The Illinois Adoption Registry shall release
13information regarding the date the adoption was finalized and
14the county in which the adoption was finalized to a certified
15confidential intermediary upon submission of a court order.
16    (f) In cases where the Illinois Adoption Registry
17possesses information indicating that an adopted person who is
1821 years of age or over was adopted in a state other than
19Illinois or a country other than the United States, the
20Illinois Adoption Registry shall release the name of the state
21or country where the adoption was finalized and, if available,
22the agency involved in the adoption to a registrant of the
23Illinois Adoption Registry, provided the registrant is not the
24subject of a Denial of Information Exchange and the registrant
25has completed a Medical Information Exchange Authorization.
26    (g) Any of the above available information for any

1adoption proceedings completed before the effective date of
2this Act shall be supplied to the adoptive parents or an
3adoptee 18 years of age or over upon request.
4    (h) The agency, Department of Children and Family
5Services, Court Supportive Services, Juvenile Division of the
6Circuit Court, the Probation Officers of the Circuit Court and
7any other governmental bodies having any of the above
8information shall retain the file until the adoptee would have
9reached the age of 99 years.
