AMENDMENT TO SENATE BILL 2902

2    AMENDMENT NO. ______. Amend Senate Bill 2902 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The North Shore Water Reclamation District Act
5is amended by changing Sections 4 and 10 as follows:
 
6    (70 ILCS 2305/4)  (from Ch. 42, par. 280)
7    Sec. 4. Board of trustees; powers; compensation. The
8trustees shall constitute a board of trustees for the
9district. The board of trustees is the corporate authority of
10the district, and shall exercise all the powers and manage and
11control all the affairs and property of the district. The
12board shall elect a president and vice-president from among
13their own number. In case of the death, resignation, absence
14from the state, or other disability of the president, the
15powers, duties and emoluments of the office of the president
16shall devolve upon the vice-president, until the disability is

1removed or until a successor to the president is appointed and
2chosen in the manner provided in this Act. The board may select
3a secretary, treasurer, executive director, and attorney, and
4may provide by ordinance for the employment of other employees
5as the board may deem necessary for the municipality. The
6board may appoint such other officers and hire such employees
7to manage and control the operations of the district as it
8deems necessary; provided, however, that the board shall not
9employ an individual as a wastewater operator whose
10Certificate of Technical Competency is suspended or revoked
11under rules adopted by the Pollution Control Board under item
12(4) of subsection (a) of Section 13 of the Environmental
13Protection Act. All employees selected by the board shall hold
14their respective offices during the pleasure of the board, and
15give such bond as may be required by the board. The board may
16prescribe the duties and fix the compensation of all the
17officers and employees of the sanitary district. Except as
18otherwise provided in this Section However, the president of
19the board shall not receive more than $18,000 per year, and
20each other member of the board shall not receive more than
21$15,000 per year. Upon a unanimous vote, the board of trustees
22may elect to raise compensation to $18,750 per year for board
23members and $21,750 per year for the president of the board.
24The board of trustees has full power to pass all necessary
25ordinances, rules, and regulations for the proper management
26and conduct of the business of the board and of the

1corporation, and for carrying into effect the objects for
2which the sanitary district was formed. The ordinances may
3provide for a fine for each offense of not less than $100 or
4more than $1,000. Each day's continuance of a violation shall
5be a separate offense. Fines under this Section are
6recoverable by the sanitary district in a civil action. The
7sanitary district is authorized to apply to the circuit court
8for injunctive relief or mandamus when, in the opinion of the
9chief administrative officer, the relief is necessary to
10protect the sewerage system of the sanitary district.
11    The board of trustees shall have the authority to change
12the name of the District, by ordinance, to the North Shore
13Water Reclamation District. Any such name change shall not
14impair the legal status of any act by the sanitary district. If
15an ordinance is passed pursuant to this paragraph, all
16provisions of this Act shall apply to the newly renamed
17district. No rights, duties, or privilege of such sanitary
18district or of any person existing before the change of name
19shall be affected by the change in the name of the sanitary
20district. All proceedings pending in any court relating to
21such sanitary district may continue to final consummation
22under the name in which they were commenced.

2revenue a direct annual tax sufficient to pay the interest on
3such debt as it falls due, and also to pay and discharge the
4principal thereof as the same shall fall due, and at least
5within 40 twenty years from the time of contracting the same.
