SYNOPSIS AS INTRODUCED:

30 ILCS 500/50-87 new

Amends the Illinois Procurement Code. Provides that each State purchasing agency shall submit a procurement reform report to the Governor and the General Assembly. Creates the Reforming State Procurement Task Force. Sets forth the membership of the Task Force. Provides that the Task Force shall conduct public hearings to review and take testimony on the reports filed by the State purchasing agencies. Provides that the Task Force shall submit certain reports. Effective immediately.

A BILL FOR

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Procurement Code is amended by adding Section 50-87 as follows:

(30 ILCS 500/50-87 new)

Sec. 50-87. Procurement reports; Reforming State Procurement Task Force.

(a) It is the intent of the General Assembly to address concerns raised by State agencies during Senate Appropriations Committee hearings about the current procurement process. It is also the intent of the General Assembly to create a procurement system that is effective, efficient, transparent, and free of corruption and steering.

(b) On or before December 31, 2026, each State purchasing agency shall submit a procurement reform report to the Governor and the General Assembly that sets forth the following:

(1) concerns about the current procurement process, including specific, real issues and a list of the problematic statutory provisions or rules; and

(2) recommendations for how the procurement process can be reformed to be more efficient, effective, transparent, and free of corruption; these recommendations shall include specific legislative language to effectuate the recommendation.

(c) There is hereby created the Reforming State Procurement Task Force. The Task Force shall conduct public hearings to review and take testimony on the reports filed by the State purchasing agencies under subsection (b). The Task Force shall consist of the following appointees who shall be appointed by January 15, 2027:

(1) the Chief Procurement Officer for the Capital Development Board;

(2) the Chief Procurement Officer for the Department of Transportation;

(3) the Chief Procurement Officer for General Services;

(4) the Chief Procurement Officer for Higher Education;

(5) the Director of Central Management Services or his or her designee;

(6) the Secretary of Transportation or his or her designee;

(7) the chairperson of the Capital Development Board or his or her designee;

(8) 2 employees of a State agency who deal with procurement, appointed by the Governor; these appointees shall not be from the same agency;

(9) 2 Illinois vendors and one member of the House of Representatives, all appointed by the Speaker of the House of Representatives;

(10) 2 Illinois vendors and one member of the House of Representatives, all appointed by the Minority Leader of the House of Representatives;

(11) 2 Illinois vendors and one Senator, all appointed by the President of the Senate;

(12) 2 Illinois vendors and one Senator, all appointed by the Minority Leader of the Senate.

(d) The Task Force shall conduct its first hearing by February 1, 2027 and must conduct at least 4 additional hearings before April 15, 2027.

(e) The Task Force shall submit a report to the Governor and the General Assembly by May 1, 2027 that outlines recommendations and legislative language for legislative changes to the State procurement process.

(f) This Section is repealed on January 1, 2028.

Section 99. Effective date. This Act takes effect upon becoming law.
