SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/34-2.2  from Ch. 122, par. 34-2.2

    Amends the Article of the School Code concerning the Chicago school district. Removes the prohibition on student members of a local school council being counted for purposes of determining whether a quorum is present to act and having a vote on the following measures: (i) the evaluation of a principal; (ii) the renewal of a principal's performance contract or the inclusion of any provision or modification of the contract; (iii) the direct selection by the local school council of a new principal to serve under a 4-year performance contract; or (iv) the determination of the names of candidates to be submitted to the general superintendent for the position of principal. Requires 8 affirmative votes of the local school council at attendance centers enrolling students through grade 8 and 9 affirmative votes of the local school council at secondary attendance centers (rather than 7) for the direct selection by the local school council of a new principal. Provides that student members of a local school council shall count toward a quorum on all measures brought before the local school council. Removes the prohibition on student members of a local school council being eligible to vote on personnel matters and the allocation of teaching and staff resources.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
534-2.2 as follows:
 
6    (105 ILCS 5/34-2.2)  (from Ch. 122, par. 34-2.2)
7    Sec. 34-2.2. Local school councils; manner of operation.
8    (a) The annual organizational meeting of each local school
9council shall be held at the attendance center or via
10videoconference or teleconference if guidance from the
11Department of Public Health or Centers for Disease Control and
12Prevention limits the size of in-person meetings at the time
13of the meeting. At the annual organization meeting, which
14shall be held no sooner than July 1 and no later than July 14,
15a parent member of the local school council shall be selected
16by the members of such council as its chairperson, and a
17secretary shall be selected by the members of such council
18from among their number, each to serve a term of one year.
19However, an organizational meeting held by members elected to
20a local school council under subsection (c-5) of Section
2134-2.1 may be held no sooner than January 11, 2021 and no later
22than January 31, 2021. Whenever a vacancy in the office of
23chairperson or secretary of a local school council shall

1occur, a new chairperson (who shall be a parent member) or
2secretary, as the case may be, shall be elected by the members
3of the local school council from among their number to serve as
4such chairperson or secretary for the unexpired term of office
5in which the vacancy occurs. At each annual organizational
6meeting, the time and place of any regular meetings of the
7local school council shall be fixed. Special meetings of the
8local school council may be called by the chairperson or by any
94 members from an attendance center enrolling students up to
10grade 8 or any 5 members from a secondary attendance center or
11an attendance center enrolling students in grades 7 through
1212, by giving notice thereof in writing, specifying the time,
13place and purpose of the meeting. Public notice of meetings
14shall also be given in accordance with the Open Meetings Act.
15    (b) Members and officers of the local school council shall
16serve without compensation and without reimbursement of any
17expenses incurred in the performance of their duties, except
18that the board of education may by rule establish a procedure
19and thereunder provide for reimbursement of members and
20officers of local school councils for such of their reasonable
21and necessary expenses (excluding any lodging or meal
22expenses) incurred in the performance of their duties as the
23board may deem appropriate.
24    (c) A majority of the full membership of the local school
25council shall constitute a quorum, except as provided in
26subsection (c-5), and whenever a vote is taken on any measure

1before the local school council, a quorum being present, the
2affirmative vote of a majority of the votes of the full
3membership then serving of the local school council shall
4determine the outcome thereof; provided that whenever the
5measure before the local school council is (i) the evaluation
6of the principal, or (ii) the renewal of his or her performance
7contract or the inclusion of any provision or modification of
8the contract, or (iii) the direct selection by the local
9school council of a new principal (including a new principal
10to fill a vacancy) to serve under a 4 year performance
11contract, or (iv) the determination of the names of candidates
12to be submitted to the general superintendent for the position
13of principal, the principal and any student members of a local
14school council shall not be counted for purposes of
15determining whether a quorum is present to act on the measure
16and shall have no vote thereon; and provided further that 8 7
17affirmative votes of the local school council at attendance
18centers enrolling students through grade 8 and 9 affirmative
19votes of the local school council at secondary attendance
20centers shall be required for the direct selection by the
21local school council of a new principal to serve under a 4 year
22performance contract but not for the renewal of a principal's
23performance contract. Student members of a local school
24council shall count toward a quorum on all measures brought
25before the local school council.
26    (c-5) If the number of members serving on a local school

1council at an attendance center enrolling students through the
28th grade falls below 7 members due to vacancies, then 4
3serving members of whom at least 2 are parent or community
4members of the local school council shall constitute a quorum
5for the sole purpose of convening a meeting to fill vacancies
6through appointments in accordance with the process set forth
7in Section 34-2.1 of this Code. If the number of members
8serving on a local school council at a secondary attendance
9center falls below 8 members due to vacancies, then 5 serving
10members of whom at least 2 are parent or community members of
11the local school council shall constitute a quorum for the
12sole purpose of convening a meeting to fill vacancies through
13appointments in accordance with the process set forth in
14Section 34-2.1 of this Code. For such purposes, the
15affirmative vote of a majority of those present shall be
16required to fill a vacancy through appointment by the local
17school council.
18    (d) (Blank). Student members shall not be eligible to vote
19on personnel matters, including but not limited to principal
20evaluations and contracts and the allocation of teaching and
21staff resources.
22    (e) The local school council of an attendance center which
23provides bilingual education shall be encouraged to provide
24translators at each council meeting to maximize participation
25of parents and the community.
26    (f) Each local school council of an attendance center

1which provides bilingual education shall create a Bilingual
2Advisory Committee or recognize an existing Bilingual Advisory
3Committee as a standing committee. The Chair and a majority of
4the members of the advisory committee shall be parents of
5students in the bilingual education program. The parents on
6the advisory committee shall be selected by parents of
7students in the bilingual education program, and the committee
8shall select a Chair. The advisory committee for each
9secondary attendance center shall include at least one
10full-time bilingual education student. The Bilingual Advisory
11Committee shall serve only in an advisory capacity to the
12local school council.
13    (g) Local school councils may utilize the services of an
14arbitration board to resolve intra-council disputes.
