SYNOPSIS AS INTRODUCED:
 
215 ILCS 5/356z.33

    Amends the Illinois Insurance Code. Provides that a group or individual policy of accident and health insurance or a managed care plan that is amended, issued, delivered, or renewed on or after January 1, 2028 shall provide coverage for medically necessary epinephrine delivery systems. Removes language providing that "epinephrine injector" has the meaning set forth in the Epinephrine Injector Act. Provides that "epinephrine injector" includes an auto-injector approved by the United States Food and Drug Administration for the administration of epinephrine and a pre-filled syringe approved by the United States Food and Drug Administration and used for the administration of epinephrine that contains a pre-measured dose of epinephrine that is equivalent to the dosages used in an auto-injector. Includes epinephrine delivery systems in provisions concerning cost limitations for medically necessary epinephrine injectors.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Insurance Code is amended by
5changing Section 356z.33 as follows:
 
6    (215 ILCS 5/356z.33)
7    Sec. 356z.33. Coverage for epinephrine injectors and
8epinephrine delivery systems.
9    (a) As used in this Section:
10    "Epinephrine delivery system" has the meaning given to
11that term in Section 5 of the Epinephrine Injector Act.
12    "Epinephrine injector" includes an auto-injector approved
13by the United States Food and Drug Administration for the
14administration of epinephrine and a pre-filled syringe
15approved by the United States Food and Drug Administration and
16used for the administration of epinephrine that contains a
17pre-measured dose of epinephrine that is equivalent to the
18dosages used in an auto-injector.
19    (b) (a) A group or individual policy of accident and
20health insurance or a managed care plan that is amended,
21delivered, issued, or renewed on or after January 1, 2020 (the
22effective date of Public Act 101-281) shall provide coverage
23for medically necessary epinephrine injectors for persons 18

1years of age or under. As used in this Section, "epinephrine
2injector" has the meaning given to that term in Section 5 of
3the Epinephrine Injector Act.
4    (c) A group or individual policy of accident and health
5insurance or a managed care plan that is amended, issued,
6delivered, or renewed on or after January 1, 2028 shall
7provide coverage for medically necessary epinephrine delivery
8systems.
9    (d) (b) An insurer that provides coverage for medically
10necessary epinephrine injectors or epinephrine delivery
11systems shall limit the total amount that an insured is
12required to pay for a twin-pack of medically necessary
13epinephrine injectors or epinephrine delivery systems, at an
14amount not to exceed $60, regardless of the type of
15epinephrine injector or delivery system; except that this
16provision does not apply to the extent such coverage would
17disqualify a high-deductible health plan from eligibility for
18a health savings account pursuant to Section 223 of the
19Internal Revenue Code (26 U.S.C. 223).
20    (e) (c) Nothing in this Section prevents an insurer from
21reducing an insured's cost sharing by an amount greater than
22the amount specified in subsection (b) or (c).
23    (f) (d) The Department may adopt rules as necessary to
24implement and administer this Section.
