AMENDMENT TO SENATE BILL 2972

2    AMENDMENT NO. ______. Amend Senate Bill 2972 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Boat Registration and Safety Act is
5amended by adding Section 5-24 as follows:
 
6    (625 ILCS 45/5-24 new)
7    Sec. 5-24. Operation of motorboat, vessel, or personal
8watercraft; insurance.
9    (a) It is unlawful for the owner of a motorboat of more
10than 10 horsepower, a vessel over 21 feet long, or a personal
11watercraft to operate or allow the operation of the motorboat,
12vessel, or personal watercraft unless it is covered by a
13liability insurance policy that has been issued by an
14insurance company licensed in this State. The insurance policy
15shall provide at least $50,000 of liability coverage per
16occurrence. On and after the effective date of this amendatory

1Act of the 104th General Assembly, the Department shall not
2approve any new or renewed registration without receiving
3proof of liability insurance in accordance with this
4subsection.
5    (b) Every owner or operator of a motorboat of more than 10
6horsepower, a vessel over 21 feet long, or a personal
7watercraft shall carry within the motorboat, vessel, or
8personal watercraft evidence of insurance. The evidence shall
9be legible and sufficient to demonstrate that the motorboat,
10vessel, or personal watercraft is currently covered by a
11liability insurance policy as required under this Section and
12may include, but is not limited to, the following:
13        (1) an insurance card provided by the insurer under
14    this Section;
15        (2) the current declarations page of a liability
16    insurance policy;
17        (3) a liability insurance binder, certificate of
18    liability insurance, or receipt for payment to an insurer
19    or its authorized representative for a liability insurance
20    premium; or
21        (4) the display of electronic images on a cellular
22    phone or other type of portable electronic device. The use
23    of a cellular phone or other type of portable electronic
24    device to display proof of insurance does not constitute
25    consent for a law enforcement officer, court, or other
26    officer of the court to access other contents of the

1    cellular phone or other type of portable electronic
2    device. Any law enforcement officer, court, or officer of
3    the court presented with the cellular phone or other type
4    of portable electronic device shall be immune from any
5    liability resulting from damage to the cellular phone or
6    other type of portable electronic device.
7    (c) An operator or owner of a motorboat, vessel, or
8personal watercraft who violates subsection (b) commits a
9petty offense and shall be fined for a first violation not less
10than $50 nor more than $250, for a second violation not less
11than $250 nor more than $500, and for a third or subsequent
12violation not less than $500 nor more than $1,000.
13    (d) The Department is authorized to adopt rules as
14necessary to implement this Section.".
