SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/14-2

    Amends the Children with Disabilities Article of the School Code. Provides that, with respect to any State statute or administrative rule that defines a general education classroom to be composed of a certain percentage of students with individualized education programs, such percentage shall exclude students with individualized education programs receiving only speech-language pathology services outside of the general education classroom for a mild speech disorder, provided that the instruction the students receive in the general education classroom does not require modification or accommodation (rather than providing that students with individualized education programs shall exclude students receiving only speech services outside of the general education classroom, provided that the instruction the students receive in the general education classroom does not require modification). Provides that such percentage shall include students with individualized education programs receiving only speech-language pathology services outside of the general education classroom for a moderate to severe speech disorder.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
514-2 as follows:
 
6    (105 ILCS 5/14-2)
7    Sec. 14-2. Definition of general education classroom for
8special education students receiving services in the general
9education classroom.
10    (a) As used in this subsection with respect to a speech
11disorder:
12    "Mild" means the speech disorder does not interfere with
13academic or social functioning.
14    "Moderate" means the speech disorder may interfere with
15academic or social functioning and requires instructional
16modification or accommodation.
17    "Severe" means the speech disorder interferes with
18academic or social functioning and requires instructional
19modification or accommodation.
20    With respect to any State statute or administrative rule
21that defines a general education classroom to be composed of a
22certain percentage of students with individualized education
23programs (IEPs), such percentage shall exclude students with

1individualized education programs shall exclude students
2receiving only speech-language pathology speech services, as
3defined in Section 14-6.04, outside of the general education
4classroom for a mild speech disorder, provided that the
5instruction the students receive in the general education
6classroom does not require modification or accommodation.
7However, such percentage shall include students with
8individualized education programs receiving only
9speech-language pathology services outside of the general
10education classroom for a moderate to severe speech disorder.
11    (b) In every instance, a school district must ensure that
12composition of the general education classroom does not
13interfere with the provision of a free and appropriate public
14education to any student.
