    Amends the Cycle Rider Safety Training Act. Provides that any business registered as a motorcycle dealer with the Secretary of State or any other business that derives income from the selling of motorcycles or has motorcycles for sale at its place of business on a consignment basis is not eligible for grant funds or reimbursements. Makes conforming changes.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Cycle Rider Safety Training Act is amended
5by changing Sections 2.03a and 4 as follows:
 
6    (625 ILCS 35/2.03a)
7    Sec. 2.03a. Cycle Rider Safety Training Course Provider.
8"Cycle Rider Safety Training Course Provider" and "provider"
9means a community college, State university, State or local
10government agency, or for-profit or nonprofit business entity
11in good standing and operating in the State that is capable of
12providing courses meeting the definition in this Act in
13accordance with the rules set forth by the Department and the
14regulations of this Act. "Cycle Rider Safety Training Course
15Provider" and "provider" may does not include any business
16registered as a motorcycle dealer with the Secretary of State
17or any other business that derives income from the selling of
18motorcycles or has motorcycles for sale at its place of
19business on a consignment basis if the business meets all
20rules set forth by the Department and rules and regulations of
21this Act and the State does not issue any grant funds to that
22business under subsection (b) of Section 4.

2    Sec. 4. Cycle Rider Safety Training Courses.
3    (a) The Department shall, on an as needed basis, put out
4notices to the public seeking Cycle Rider Safety Training
5Course Providers to provide courses in this State. Such
6courses shall be open to all residents of the State who hold a
7currently valid driver's license and who have reached their
816th birthday before the first day of the course to be held.
9Such courses may be offered throughout the calendar year.
10    Providers may charge a nominal registration fee set by the
11Department, which shall be refunded upon completion of the
12course.
13    Responses from potential providers shall include, at a
14minimum, the location where classes are to be held at, the
15number of students they intend to train, whether they would be
16providing motorcycles or using motorcycles provided by the
17program, and the cost for courses provided on a per student
18basis.
19    Contracts shall be awarded by the Department to providers
20based on training needs and cost effectiveness of each bid or
21proposal as well as the provider's organizational capacity to
22satisfactorily discharge Cycle Rider Safety Training Courses.
23    (b) A provider shall only be paid grant funds under one of
24the following conditions:
25        (1) a course was held, in which case the provider

1    shall be paid per student rate multiplied by the number of
2    students present on the first day of the course;
3        (2) expenses submitted related to the maintenance of
4    program equipment; or
5        (3) submitting other non-personnel expenses as deemed
6    appropriate by the Department.
7    Any business registered as a motorcycle dealer with the
8Secretary of State or any other business that derives income
9from the selling of motorcycles or has motorcycles for sale at
10its place of business on a consignment basis is not eligible
11for grant funds or reimbursements.
12    (c) A provider awarded a contract with grant funding under
13this Act shall:
14        (1) submit proof to the Department that each
15    instructor employed by the provider meets the
16    qualifications to teach the curriculum for the courses;
17        (2) have at least one employee on staff certified to
18    do quality assurance or quality control visits where
19    instructors are evaluated per curriculum standards on
20    teaching;
21        (3) perform at least one quality assurance or quality
22    control visit on each instructor employed during the year
23    and submit the results of those visits to the Department;
24        (4) maintain appropriate liability insurance to cover
25    training activities;
26        (5) submit requests for payment in a timely manner;

1    and
2        (6) adhere to additional program rules and regulations
3    as determined by the Department.
4    (d) A provider awarded a contract with or without grant
5funding under this Act shall not adopt any policy,
6requirement, or expectation regarding employee's manner of
7dress outside of the employee's scheduled work hours, nor may
8the provider pose any questions regarding such on job
9applications or during interviews with potential employees.
