AMENDMENT TO SENATE BILL 3290

2    AMENDMENT NO. ______. Amend Senate Bill 3290 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Cycle Rider Safety Training Act is amended
5by changing Section 2, 2.03a, and 4 and by adding Sections
62.03b and 2.07 as follows:
 
7    (625 ILCS 35/2)  (from Ch. 95 1/2, par. 802)
8    Sec. 2. As used in this Act, the terms specified in
9Sections 2.01 through 2.07 2.06 have the meanings ascribed to
10them in those Sections unless the context clearly requires a
11different meaning.

1means a community college, State university, State or local
2government agency, or for-profit or nonprofit business entity
3in good standing and operating in the State that is capable of
4providing courses meeting the definition in this Act in
5accordance with the rules set forth by the Department and the
6regulations of this Act. "Cycle Rider Safety Training Course
7Provider" and "provider" does not include any business
8registered as a motorcycle dealer with the Secretary of State
9or any other business that derives income from the selling of
10motorcycles or has motorcycles for sale at its place of
11business on a consignment basis.

14    Sec. 2.03b. Dealer Provider. "Dealer Provider" means any
15business registered as a motorcycle dealer holding a vehicle
16Dealer License with the Secretary of State and is a registered
17school with the Secretary of State.

19    Sec. 2.07. Provider. "Provider" means a Cycle Rider Safety
20Training Course Provider or Dealer Provider.

22    Sec. 4. Cycle Rider Safety Training Courses.
23    (a) The Department shall, on an as needed basis, put out

1notices to the public seeking Cycle Rider Safety Training
2Course Providers or Dealer Providers to provide courses in
3this State. Such courses shall be open to all residents of the
4State who hold a currently valid driver's license and who have
5reached their 16th birthday before the first day of the course
6to be held. Such courses may be offered throughout the
7calendar year.
8    Providers may charge a nominal registration fee set by the
9Department, which shall be refunded upon completion of the
10course.
11    Responses from potential providers shall include, at a
12minimum, the location where classes are to be held at, the
13number of students they intend to train, whether they would be
14providing motorcycles or using motorcycles provided by the
15program, and the cost for courses provided on a per student
16basis.
17    Contracts shall be awarded by the Department to providers
18based on training needs and cost effectiveness of each bid or
19proposal as well as the provider's organizational capacity to
20satisfactorily discharge Cycle Rider Safety Training Courses.
21    (b) A Cycle Rider Safety Training Course Provider provider
22shall only be paid grant funds under one of the following
23conditions:
24        (1) a course was held, in which case the provider
25    shall be paid per student rate multiplied by the number of
26    students present on the first day of the course;

1        (2) expenses submitted related to the maintenance of
2    program equipment; or
3        (3) submitting other non-personnel expenses as deemed
4    appropriate by the Department.
5    (c) A Cycle Rider Safety Training Course Provider provider
6awarded a contract with grant funding under this Act shall:
7        (1) submit proof to the Department that each
8    instructor employed by the provider meets the
9    qualifications to teach the curriculum for the courses;
10        (2) have at least one employee on staff certified to
11    do quality assurance or quality control visits where
12    instructors are evaluated per curriculum standards on
13    teaching;
14        (3) perform at least one quality assurance or quality
15    control visit on each instructor employed during the year
16    and submit the results of those visits to the Department;
17        (4) maintain appropriate liability insurance to cover
18    training activities;
19        (5) submit requests for payment in a timely manner;
20    and
21        (6) adhere to additional program rules and regulations
22    as determined by the Department.
23    (d) A Cycle Rider Safety Training Course Provider provider
24awarded a contract with grant funding under this Act and a
25dealer provider operating under subsection (e) shall not adopt
26any policy, requirement, or expectation regarding employee's

1manner of dress outside of the employee's scheduled work
2hours, nor may the provider pose any questions regarding such
3on job applications or during interviews with potential
4employees.
5    (e) A Dealer Provider may provide courses under this Act
6to the public for a fee which shall not be refunded. A Dealer
7Provider may set up ranges and courses without responding to
8notices from the Department as described in subsection (a) and
9are ineligible for grant funds from the Cycle Rider Safety
10Training Fund as described in subsection (b). A Dealer
11Provider offering courses under this subsection shall:
12        (1) submit proof to the Department that each
13    instructor employed by the Dealer Provider meets the
14    qualifications to teach the curriculum for the courses;
15        (2) have at least one employee on staff certified to
16    do quality assurance or quality control visits where
17    instructors are evaluated per curriculum standards on
18    teaching;
19        (3) perform at least one quality assurance or quality
20    control visit on each instructor employed during the year
21    and submit the results of those visits to the Department;
22        (4) maintain appropriate liability insurance to cover
23    training activities; and
24        (5) adhere to rules as determined by the Department.
