SYNOPSIS AS INTRODUCED:
 
50 ILCS 705/10.19

    Amends the Illinois Police Training Act. Provides that the Illinois Law Enforcement Training Standards Board shall conduct or approve a required (rather than optional) advanced training program for law enforcement officers to recognize and respond to anaphylaxis, including the administration of an epinephrine auto-injector. Provides that a local law enforcement agency shall authorize (rather than may authorize) a law enforcement officer who has completed the required advanced training regarding anaphylaxis and the administration of an epinephrine auto-injector to carry, administer, or assist with the administration of epinephrine auto-injectors provided by the local law enforcement agency whenever the officer is performing official duties. Allows rulemaking by the Illinois Law Enforcement Training Standards Board to implement the amendatory Act.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Police Training Act is amended by
5adding Section 10.19 as follows:
 
6    (50 ILCS 705/10.19)
7    Sec. 10.19. Training; administration of epinephrine.
8    (a) This Section, along with Section 40 of the Illinois
9State Police Act, may be referred to as the Annie LeGere Law.
10    (b) For purposes of this Section, "epinephrine
11auto-injector" means a single-use device used for the
12automatic injection of a pre-measured dose of epinephrine into
13the human body prescribed in the name of a local law
14enforcement agency.
15    (c) The Board shall conduct or approve a required an
16optional advanced training program for law enforcement
17officers to recognize and respond to anaphylaxis, including
18the administration of an epinephrine auto-injector. The
19training must include, but is not limited to:
20        (1) how to recognize symptoms of an allergic reaction;
21        (2) how to respond to an emergency involving an
22    allergic reaction;
23        (3) how to administer an epinephrine auto-injector;

1        (4) how to respond to an individual with a known
2    allergy as well as an individual with a previously unknown
3    allergy;
4        (5) a test demonstrating competency of the knowledge
5    required to recognize anaphylaxis and administer an
6    epinephrine auto-injector; and
7        (6) other criteria as determined in rules adopted by
8    the Board.
9    (d) A local law enforcement agency shall may authorize a
10law enforcement officer who has completed the required an
11optional advanced training program under subsection (c) to
12carry, administer, or assist with the administration of
13epinephrine auto-injectors provided by the local law
14enforcement agency whenever the officer is performing official
15duties.
16    (e) Each A local law enforcement agency that authorizes
17its officers to carry and administer epinephrine
18auto-injectors under subsection (d) must establish a policy to
19control the acquisition, storage, transportation,
20administration, and disposal of epinephrine auto-injectors and
21to provide continued training in the administration of
22epinephrine auto-injectors.
23    (f) A physician, physician assistant with prescriptive
24authority, or advanced practice registered nurse with
25prescriptive authority may provide a standing protocol or
26prescription for epinephrine auto-injectors in the name of a

1local law enforcement agency to be maintained for use when
2necessary.
3    (g) When a law enforcement officer administers an
4epinephrine auto-injector in good faith, the law enforcement
5officer and local law enforcement agency, and its employees
6and agents, including a physician, physician assistant with
7prescriptive authority, or advanced practice registered nurse
8with prescriptive authority who provides a standing order or
9prescription for an epinephrine auto-injector, incur no civil
10or professional liability, except for willful and wanton
11conduct, or as a result of any injury or death arising from the
12use of an epinephrine auto-injector.
13    (h) The Board shall adopt rules to implement this Section,
14including, but not limited to:
15        (1) minimum training standards;
16        (2) guidelines to control the acquisition, storage,
17    transportation, administration, and disposal of
18    epinephrine auto-injectors; and
19        (3) documentation and reporting requirements following
20    the administration of epinephrine by a law enforcement
21    officer.
