SYNOPSIS AS INTRODUCED:
 
    Authorizes the Director of Department of Natural Resources to convey a nonexclusive easement in Knox County to Nancy J. and Robert D. Moore, co-trustees of the Dean Moore Family Trust. Effective immediately.

1    AN ACT concerning property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. Upon the payment of the sum of $1.00 to the
5State of Illinois, the Director of Natural Resources is
6authorized to convey a nonexclusive easement to Nancy J. and
7Robert D. Moore, co-trustees of the Dean Moore Family Trust,
8and their successors or assigns, more particularly described
9as follows:
 
10    A 25-FT WIDE INGRESS/EGRESS EASEMENT OVER AND ACROSS PART
11    OF THE EAST HALF OF THE NORTHEAST QUARTER OF SECTION 13,
12    TOWNSHIP 11 NORTH, RANGE 3 EAST AND PART OF THE WEST HALF
13    OF THE NORTHWEST QUARTER OF SECTION 18, TOWNSHIP 11 NORTH,
14    RANGE 4 EAST OF THE 4TH PRINCIPAL MERIDIAN; THE CENTERLINE
15    OF SAID EASEMENT IS MORE PARTICULARLY DESCRIBED AS
16    FOLLOWS:
17    COMMENCING AT A 5/8" IRON ROD FOUND AT THE SOUTHWEST
18    CORNER OF THE EAST HALF OF SAID NORTHEAST QUARTER, ALSO

5    THE SIDELINES OF SAID EASEMENT SHALL BE EXTENDED OR
6    TRUNCATED TO TERMINATE ON THE SOUTH LINE OF PARCEL
7    11-13-400-006 AND THE SOUTH LINE OF PARCEL 12-18-100-001.
8    THE SOUTH LINE OF 12-18-100-001 IS THE COMMON LINE TO
9    PARCEL 12-18-300-001 AS EVIDENCED BY AN EXISTING FENCE
10    LINE AND IS THE ACCEPTED PROPERTY LINE REGARDLESS OF THE
11    MINOR DIFFERENCE AS INDICATED IN THE GOVERNMENT LAND
12    OFFICE SURVEY AND PUBLISHED PLATS DEPICTING THE 26.6 LINKS
13    (17.74 FEET) DIFFERENCE BETWEEN QUARTER-CORNERS OF
14    SECTIONS 13 AND 18 AND SHOWN ON THE ANNEXED PLAT.
15    THE ABOVE-DESCRIBED REAL ESTATE HAVING AN AREA OF 0.83
16    ACRES, MORE OR LESS.
 
17    Section 10. The conveyance of the easement authorized by
18Section 5 is made subject to: (1) existing public utilities,
19existing public roads, and any and all reservations,
20easements, encumbrances, covenants and restrictions of record;
21(2) the entering into of a shared maintenance agreement for
22the land listed in Section 5 that is the subject of the
23easement between the Department of Natural Resources and Nancy
24J. and Robert D. Moore, co-trustees of the Dean Moore Family
25Trust, and their successors or assigns; and (3) the express

1condition that if either the Department of Natural Resources
2or Nancy J. and Robert D. Moore, co-trustees of the Dean Moore
3Family Trust, and their successors or assigns, ceases to have
4a shared maintenance agreement for the land that is the
5subject of the easement in Section 5, the easement
6automatically terminates and the land reverts to the State of
7Illinois, Department of Natural Resources.
 
8    Section 15. The Director of Natural Resources shall obtain
9a certified copy of this Act within 60 days after the Act
10becomes law and record the Act in the Recorder's Office of Knox
11County, Illinois after the Department of Natural Resources and
12Nancy J. and Robert D. Moore have entered into a shared
13maintenance agreement as required in Section 10.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.
