| 8 | | and their successors or assigns, more particularly described |

| 1 | | Section 10. The conveyance of the easement authorized by |
| 2 | | Section 5 is made subject to: (1) existing public utilities, |
| 3 | | existing public roads, and any and all reservations, |
| 4 | | easements, encumbrances, covenants and restrictions of record; |
| 5 | | (2) the entering into of a shared maintenance agreement for |
| 6 | | the land listed in Section 5 that is the subject of the |
| 7 | | easement between the Department of Natural Resources and Nancy |
| 8 | | J. and Robert D. Moore, co-trustees of the Dean Moore Family |
| 9 | | Trust, and their successors or assigns; and (3) the express |
| 10 | | condition that if either the Department of Natural Resources |
| 11 | | or Nancy J. and Robert D. Moore, co-trustees of the Dean Moore |
| 12 | | Family Trust, and their successors or assigns, ceases to have |
| 13 | | a shared maintenance agreement for the land that is the |
| 14 | | subject of the easement in Section 5, the easement |
| 15 | | automatically terminates and the land reverts to the State of |
| 16 | | Illinois, Department of Natural Resources. |
| 17 | | Section 15. The Director of Natural Resources shall obtain |
| 18 | | a certified copy of this Act within 60 days after the Act |
| 19 | | becomes law and record the Act in the Recorder's Office of Knox |
| 20 | | County, Illinois after the Department of Natural Resources and |
| 21 | | Nancy J. and Robert D. Moore have entered into a shared |
| 22 | | maintenance agreement as required in Section 10. |
| 23 | | Section 99. Effective date. This Act takes effect upon |
