AMENDMENT TO SENATE BILL 3379

2    AMENDMENT NO. ______. Amend Senate Bill 3379 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. Upon the payment of the sum of $1.00 to the
5State of Illinois, the Director of Natural Resources is
6authorized to convey a nonexclusive easement to Nancy J. and
7Robert D. Moore, co-trustees of the Dean Moore Family Trust,
8and their successors or assigns, more particularly described
9as follows:
 
10    A 25-FT WIDE INGRESS/EGRESS EASEMENT OVER AND ACROSS PART
11    OF THE EAST HALF OF THE NORTHEAST QUARTER OF SECTION 13,
12    TOWNSHIP 11 NORTH, RANGE 3 EAST OF THE 4TH PRINCIPAL
13    MERIDIAN; THE CENTERLINE OF SAID EASEMENT IS MORE
14    PARTICULARLY DESCRIBED AS FOLLOWS:
15    COMMENCING AT A 5/8-INCH IRON ROD FOUND AT THE SOUTHWEST

24    NORTHEAST QUARTER OF SAID SECTION 13.
25    THE ABOVE-DESCRIBED REAL ESTATE HAVING AN AREA OF 0.82

1    Section 10. The conveyance of the easement authorized by
2Section 5 is made subject to: (1) existing public utilities,
3existing public roads, and any and all reservations,
4easements, encumbrances, covenants and restrictions of record;
5(2) the entering into of a shared maintenance agreement for
6the land listed in Section 5 that is the subject of the
7easement between the Department of Natural Resources and Nancy
8J. and Robert D. Moore, co-trustees of the Dean Moore Family
9Trust, and their successors or assigns; and (3) the express
10condition that if either the Department of Natural Resources
11or Nancy J. and Robert D. Moore, co-trustees of the Dean Moore
12Family Trust, and their successors or assigns, ceases to have
13a shared maintenance agreement for the land that is the
14subject of the easement in Section 5, the easement
15automatically terminates and the land reverts to the State of
16Illinois, Department of Natural Resources.
 
17    Section 15. The Director of Natural Resources shall obtain
18a certified copy of this Act within 60 days after the Act
19becomes law and record the Act in the Recorder's Office of Knox
20County, Illinois after the Department of Natural Resources and
21Nancy J. and Robert D. Moore have entered into a shared
22maintenance agreement as required in Section 10.
 
23    Section 99. Effective date. This Act takes effect upon
