| 1 | | AN ACT concerning regulation. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Hospital Licensing Act is amended by |
| 5 | | changing Section 6.14i as follows: |
| 6 | | (210 ILCS 85/6.14i new) |
| 7 | | Sec. 6.14i. Prohibited disclosure of gender-affirming care |
| 8 | | information. A hospital or health care professional shall not |
| 9 | | disclose or threaten to disclose to any other person, entity, |
| 10 | | or agency information regarding or relating to |
| 11 | | gender-affirming care of a minor or personally identifiable |
| 12 | | information regarding a minor receiving gender-affirming care, |
| 13 | | unless disclosure is in strict accordance with all applicable |
| 14 | | local, State, and federal law, including, but not limited to, |
| 15 | | the Health Insurance Portability and Accountability Act of |
| 16 | | 1996, as amended, and its implementing regulations, including, |
| 17 | | but not limited to, the Privacy Rule (45 CFR Parts 160, 162, |
| 18 | | and 164) and including, but not limited to, 45 CFR 164.512(e) |
| 19 | | and 45 CFR 164.512(f). |
