SYNOPSIS AS INTRODUCED:
 
20 ILCS 405/405-550 new

    Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Creates the Disability Benefits Maximization Program. Provides that, within 6 months after the effective date of the amendatory Act, the Department of Central Management Services, in conjunction with the 5 State-funded retirement systems, shall enter into a contract with an administrator to establish and conduct a Disability Benefits Maximization Program to identify individuals eligible for but not enrolled in Medicare, and to assist those individuals with enrolling in Social Security and Medicare. Provides that the Disability Benefits Maximization Program shall conduct an annual audit of the State health benefits program for everyone covered under the State Employees Group Insurance Program, the Teachers' Retirement Insurance Program, and the College Insurance Program for the purpose of identifying participants and their dependents who are eligible for Medicare under federal law and shall also ensure that those annuitants, retirees, benefit recipients, survivors, and dependents who are eligible for Medicare are enrolled in Medicare with Medicare as their primary health care benefits coverage and the State health benefits program being the secondary provider of their health care benefits coverage. Provides that the Disability Benefits Maximization Program shall assist annuitants, retirees, benefit recipients, and their survivors and dependents who become disabled and are not enrolled in Social Security Disability Insurance and Medicare with enrolling in and obtaining Social Security Disability Insurance and Medicare benefits. Provides that the administrator of the Disability Benefits Maximization Program shall provide the Department, the 5 State-funded retirement systems, and the General Assembly with an annual report. Effective January 1, 2027.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-550 as follows:
 
7    (20 ILCS 405/405-550 new)
8    Sec. 405-550. Disability Benefits Maximization Program.
9    (a) Within 6 months after the effective date of this
10amendatory Act of the 104th General Assembly, the Department
11of Central Management Services, in conjunction with the State
12Employees' Retirement System of Illinois, the State
13Universities Retirement System, the Teachers' Retirement
14System of the State of Illinois, the Judges Retirement System
15of Illinois, and the General Assembly Retirement System, shall
16enter into a contract with a qualified and experienced
17administrator to establish and conduct a Disability Benefits
18Maximization Program to identify annuitants, retirees, benefit
19recipients, and their survivors or dependents who are eligible
20for but not enrolled in Medicare, and to assist those
21annuitants, retirees, benefit recipients, survivors, and
22dependents with enrollment in Social Security and Medicare.
23    (b) The Disability Benefits Maximization Program shall

1conduct an annual audit of the State health benefits program
2for everyone covered under the State Employees Group Insurance
3Program, the Teachers' Retirement Insurance Program, and the
4College Insurance Program for the purpose of identifying
5participants and their dependents who are eligible for
6Medicare under federal law. The Program shall also ensure that
7those annuitants, retirees, benefit recipients, survivors, and
8dependents who are eligible for Medicare are enrolled in
9Medicare with Medicare as their primary health care benefits
10coverage and the State health benefits program being the
11secondary provider of their health care benefits coverage.
12    (c) The Disability Benefits Maximization Program shall
13assist annuitants, retirees, benefit recipients, and their
14survivors and dependents who become disabled and are not
15enrolled in Social Security Disability Insurance and Medicare
16with enrolling in and obtaining Social Security Disability
17Insurance and Medicare benefits. This assistance shall
18include, but shall not be limited to: (i) developing
19communication materials to educate individuals about Social
20Security Disability Insurance benefits; (ii) performing
21multiple outreach efforts to targeted populations; (iii)
22analyzing responses to determine Social Security Disability
23Insurance eligibility; and (iv) representing qualified
24individuals on their claims for Social Security Disability
25Insurance and Medicare.
26    (d) The administrator shall provide the Department, the

1State Employees' Retirement System of Illinois, the State
2Universities Retirement System, the Teachers' Retirement
3System of the State of Illinois, the Judges Retirement System
4of Illinois, the General Assembly Retirement System, and the
5General Assembly with an annual report showing the number of
6annuitants, retirees, benefit recipients, survivors, and
7dependents who are transitioned to Social Security Disability
8Insurance and Medicare and the amount of savings realized by
9the State of Illinois.
 
10    Section 99. Effective date. This Act takes effect on
11January 1, 2027.
