SYNOPSIS AS INTRODUCED:

    Provides that the Act may be referred to as the Intelligent Speed Assistance Monitoring Act. Amends the Unified Code of Corrections. Provides that a person convicted of excessive speeding under the Illinois Vehicle Code (driving at a speed that is 26 miles per hour or more in excess of the applicable maximum speed limit established under the Speed Restrictions Article of the Code or a local ordinance) shall be subject to all of the provisions of the Illinois Vehicle Code concerning a Monitoring Device Driving Permit, except the monitoring device in question shall be an intelligent speed assistance device. Defines "excessive speeding" and "intelligent speed assistance device".

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. This Act may be referred to as the Intelligent
5Speed Assistance Monitoring Act.
 
6    Section 5. The Unified Code of Corrections is amended by
7changing Sections 5-4.5-55 and 5-4.5-60 and by adding Section
85-4.5-51 as follows:
 
9    (730 ILCS 5/5-4.5-51 new)
10    Sec. 5-4.5-51. INTELLIGENT SPEED ASSISTANCE MONITORING.
11    (a) DEFINITIONS. In this Section:
12    "Excessive speeding" refers to excessive speeding as
13defined in Section 11-601.5 of the Illinois Vehicle Code.
14    "Intelligent speed assistance device" means a technical
15device designed to be installed within a motor vehicle to
16actively monitor and prevent the driver from exceeding a
17preset limit. "Intelligent speed assistance device" does not
18include any technology that is provided by the vehicle
19manufacturer as a component of a new motor vehicle and that
20controls or affects the speed of a motor vehicle.
21    (b) SENTENCE. A person convicted of excessive speeding
22under Section 11-601.5 of the Illinois Vehicle Code shall be

1subject to all of the provisions of Section 6-206.1 of the
2Illinois Vehicle Code (Monitoring Device Driving Permit),
3except the monitoring device in question shall be an
4intelligent speed assistance device.
 
5    (730 ILCS 5/5-4.5-55)
6    Sec. 5-4.5-55. CLASS A MISDEMEANORS; SENTENCE. For a Class
7A misdemeanor:
8    (a) TERM. The sentence of imprisonment shall be a
9determinate sentence of less than one year.
10    (b) PERIODIC IMPRISONMENT. A sentence of periodic
11imprisonment shall be for a definite term of less than one
12year, except as otherwise provided in Section 5-5-3 or 5-7-1
13(730 ILCS 5/5-5-3 or 5/5-7-1).
14    (c) IMPACT INCARCERATION. See Section 5-8-1.2 (730 ILCS
155/5-8-1.2) concerning eligibility for the county impact
16incarceration program.
17    (d) PROBATION; CONDITIONAL DISCHARGE. Except as provided
18in Section 5-5-3 or 5-6-2 (730 ILCS 5/5-5-3 or 5/5-6-2), the
19period of probation or conditional discharge shall not exceed
202 years. The court shall specify the conditions of probation
21or conditional discharge as set forth in Section 5-6-3 (730
22ILCS 5/5-6-3).
23    (e) FINE. Unless otherwise specified by law, the minimum
24fine is $75. A fine not to exceed $2,500 for each offense or
25the amount specified in the offense, whichever is greater, may

1be imposed. A fine may be imposed in addition to a sentence of
2conditional discharge, probation, periodic imprisonment, or
3imprisonment. See Article 9 of Chapter V (730 ILCS 5/Ch. V,
4Art. 9) for imposition of additional amounts and determination
5of amounts and payment. If the court finds that the fine would
6impose an undue burden on the victim, the court may reduce or
7waive the fine.
8    (f) RESTITUTION. See Section 5-5-6 (730 ILCS 5/5-5-6)
9concerning restitution.
10    (g) CONCURRENT OR CONSECUTIVE SENTENCE. The sentence shall
11be concurrent or consecutive as provided in Section 5-8-4 (730
12ILCS 5/5-8-4).
13    (h) DRUG COURT. See Section 20 of the Drug Court Treatment
14Act (730 ILCS 166/20) concerning eligibility for a drug court
15program.
16    (i) CREDIT FOR HOME DETENTION. See Section 5-4.5-100 (730
17ILCS 5/5-4.5-100) concerning credit for time spent in home
18detention prior to judgment.
19    (j) GOOD BEHAVIOR ALLOWANCE. See the County Jail Good
20Behavior Allowance Act (730 ILCS 130/) for rules and
21regulations for good behavior allowance.
22    (k) ELECTRONIC MONITORING AND HOME DETENTION. See Section
235-8A-3 (730 ILCS 5/5-8A-3) concerning eligibility for
24electronic monitoring and home detention.
25    (l) SPEED MONITORING. See Section 5-4.5-51 for determining
26eligibility for intelligent speed assistance monitoring.

4    Sec. 5-4.5-60. CLASS B MISDEMEANORS; SENTENCE. For a Class
5B misdemeanor:

10as otherwise provided in Section 5-7-1 (730 ILCS 5/5-7-1).
