SYNOPSIS AS INTRODUCED:
 
5 ILCS 430/5-5

    Amends the State Officials and Employees Ethics Act. In provisions regarding personnel policies and work time requirements, specifies that State employees of public institutions of higher education classified as faculty and those not eligible for overtime pay may satisfy the time sheets requirement by complying with the terms of their contract with the public institution of higher education. Effective immediately.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Officials and Employees Ethics Act is
5amended by changing Section 5-5 as follows:

8    Sec. 5-5. Personnel policies.
9    (a) Each of the following shall adopt and implement
10personnel policies for all State employees under his, her, or
11its jurisdiction and control: (i) each executive branch
12constitutional officer, (ii) each legislative leader, (iii)
13the Senate Operations Commission, with respect to legislative
14employees under Section 4 of the General Assembly Operations
15Act, (iv) the Speaker of the House of Representatives, with
16respect to legislative employees under Section 5 of the
17General Assembly Operations Act, (v) the Joint Committee on
18Legislative Support Services, with respect to State employees
19of the legislative support services agencies, (vi) members of
20the General Assembly, with respect to legislative assistants,
21as provided in Section 4 of the General Assembly Compensation
22Act, (vii) the Auditor General, (viii) the Board of Higher
23Education, with respect to State employees of public

1institutions of higher learning except community colleges, and
2(ix) the Illinois Community College Board, with respect to
3State employees of community colleges. The Governor shall
4adopt and implement those policies for all State employees of
5the executive branch not under the jurisdiction and control of
6any other executive branch constitutional officer.
7    (b) The policies required under subsection (a) shall be
8filed with the appropriate ethics commission established under
9this Act or, for the Auditor General, with the Office of the
10Auditor General.
11    (c) The policies required under subsection (a) shall
12include policies relating to work time requirements,
13documentation of time worked, documentation for reimbursement
14for travel on official State business, compensation, and the
15earning or accrual of State benefits for all State employees
16who may be eligible to receive those benefits. No later than 30
17days after the effective date of this amendatory Act of the
18100th General Assembly, the policies shall include, at a
19minimum: (i) a prohibition on sexual harassment; (ii) details
20on how an individual can report an allegation of sexual
21harassment, including options for making a confidential report
22to a supervisor, ethics officer, Inspector General, or the
23Department of Human Rights; (iii) a prohibition on retaliation
24for reporting sexual harassment allegations, including
25availability of whistleblower protections under this Act, the
26Whistleblower Act, and the Illinois Human Rights Act; and (iv)

1the consequences of a violation of the prohibition on sexual
2harassment and the consequences for knowingly making a false
3report. The policies shall comply with and be consistent with
4all other applicable laws. The policies shall require State
5employees to periodically submit time sheets documenting the
6time spent each day on official State business to the nearest
7quarter hour; contractual State employees may satisfy the time
8sheets requirement by complying with the terms of their
9contract, which shall provide for a means of compliance with
10this requirement. The policies for State employees shall
11require those time sheets to be submitted on paper,
12electronically, or both and to be maintained in either paper
13or electronic format by the applicable fiscal office for a
14period of at least 2 years.
15    (d) The policies required under subsection (a) shall be
16adopted by the applicable entity before February 1, 2004 and
17shall apply to State employees beginning 30 days after
18adoption.

25Standards Act, may satisfy the time sheets requirement by
26complying with the terms of their contract or employment

1agreement with the public institution of higher education,
2which shall provide for a means of compliance with this
3requirement. The policies for State employees shall require
4those time sheets to be submitted on paper, electronically, or
5both and to be maintained in either paper or electronic format

8    (d) The policies required under subsection (a) shall be

13    Section 95. No acceleration or delay. Where this Act makes
14changes in a statute that is represented in this Act by text
15that is not yet or no longer in effect (for example, a Section
16represented by multiple versions), the use of that text does
17not accelerate or delay the taking effect of (i) the changes
18made by this Act or (ii) provisions derived from any other
19Public Act.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
