AMENDMENT TO SENATE BILL 3688

2    AMENDMENT NO. ______. Amend Senate Bill 3688 on page 1,
3immediately below line 3, by inserting the following:
 
4    "Section 5. The Medical School Curriculum Act is amended
5by adding Section 3 as follows:
 
6    (110 ILCS 55/3 new)
7    Sec. 3. Menopause education required. In addition to the
8requirements imposed by this Act, each and every medical
9school established, maintained, and operated by the State of
10Illinois shall include in the curriculum the study of
11perimenopause and menopause recognition and management. Such
12study may be by specific courses in perimenopause and
13menopause or may be incorporated in existing subjects taught
14in the school."; and
 
15on page 1, line 4, by replacing "5" with "10"; and

1by deleting line 19 on page 2 through line 17 on page 4; and
 
2on page 4, line 19, by replacing "Section 65-60" with
3"Sections 55-5 and 60-5"; and

6    "(225 ILCS 65/55-5)
7    (Section scheduled to be repealed on January 1, 2028)
8    Sec. 55-5. LPN education program requirements.
9    (a) All Illinois practical nurse education programs must
10be reviewed by the Board and approved by the Department before
11the successful completion of such a program may be applied
12toward meeting the requirements for practical nurse licensure
13under this Act. Any program changing the level of educational
14preparation or the relationship with or to the parent
15institution or establishing an extension of an existing
16program must request a review by the Board and approval by the
17Department. The Board shall review and make a recommendation
18for the approval or disapproval of a program by the Department
19based on the following criteria:
20        (1) a feasibility study that describes the need for
21    the program and the facilities used, the potential of the
22    program to recruit faculty and students, financial support

1    for the program, and other criteria, as established by
2    rule;
3        (2) program curriculum, including the study of
4    perimenopause and menopause recognition and management,
5    that meets all State requirements;
6        (3) the administration of the program by a Nurse
7    Administrator and the involvement of a Nurse Administrator
8    in the development of the program; and
9        (4) the occurrence of a site visit prior to approval.
10    (b) In order to obtain initial Department approval and to
11maintain Department approval, a practical nursing program must
12meet all of the following requirements:
13        (1) The program must continually be administered by a
14    Nurse Administrator.
15        (2) The institution responsible for conducting the
16    program and the Nurse Administrator must ensure that
17    individual faculty members are academically and
18    professionally competent.
19        (3) The program curriculum must contain all applicable
20    requirements established by rule, including both theory
21    and clinical components.
22        (4) The passage rates of the program's graduating
23    classes on the State-approved licensure exam must be
24    deemed satisfactory by the Department.
25    (c) Program site visits to an institution conducting or
26hosting a practical nursing program may be made at the

1discretion of the Nursing Coordinator or upon recommendation
2of the Board.
3    (d) Any institution conducting a practical nursing program
4that wishes to discontinue the program must do each of the
5following:
6        (1) Notify the Department, in writing, of its intent
7    to discontinue the program.
8        (2) Continue to meet the requirements of this Act and
9    the rules adopted thereunder until the official date of
10    termination of the program.
11        (3) Notify the Department of the date on which the
12    last student shall graduate from the program and the
13    program shall terminate.
14        (4) Assist remaining students in the continuation of
15    their education in the event of program termination prior
16    to the graduation of the program's final student.
17        (5) Upon the closure of the program, notify the
18    Department, in writing, of the location of student and
19    graduate records storage.

23    Sec. 60-5. RN education program requirements; out-of-State
24programs.
25    (a) All registered professional nurse education programs

1must be reviewed by the Board and approved by the Department
2before the successful completion of such a program may be
3applied toward meeting the requirements for registered
4professional nurse licensure under this Act. Any program
5changing the level of educational preparation or the
6relationship with or to the parent institution or establishing
7an extension of an existing program must request a review by
8the Board and approval by the Department. The Board shall
9review and make a recommendation for the approval or
10disapproval of a program by the Department based on the
11following criteria:
12        (1) a feasibility study that describes the need for
13    the program and the facilities used, the potential of the
14    program to recruit faculty and students, financial support
15    for the program, and other criteria, as established by
16    rule;
17        (2) program curriculum, including the study of
18    perimenopause and menopause recognition and management,
19    that meets all State requirements;
20        (2.5) measurement of program effectiveness based on a
21    passage rate of all graduates over the 3 most recent
22    calendar years without reference to first-time test
23    takers;
24        (3) the administration of the program by a Nurse
25    Administrator and the involvement of a Nurse Administrator
26    in the development of the program;

1        (4) the occurrence of a site visit prior to approval;
2    and
3        (5) beginning December 31, 2022, obtaining and
4    maintaining programmatic accreditation by a national
5    accrediting body for nursing education recognized by the
6    United States Department of Education and approved by the
7    Department.
8    The Department and Board of Nursing shall be notified
9within 30 days if the program loses its accreditation. The
10Department may adopt rules regarding a warning process and
11reaccreditation.
12    (b) In order to obtain initial Department approval and to
13maintain Department approval, a registered professional
14nursing program must meet all of the following requirements:
15        (1) The institution responsible for conducting the
16    program and the Nurse Administrator must ensure that
17    individual faculty members are academically and
18    professionally competent.
19        (2) The program curriculum must contain all applicable
20    requirements established by rule, including both theory
21    and clinical components.
22        (3) The passage rates of the program's graduating
23    classes on the State-approved licensure exam must be
24    deemed satisfactory by the Department.
25    (c) Program site visits to an institution conducting or
26hosting a professional nursing program may be made at the

1discretion of the Nursing Coordinator or upon recommendation
2of the Board. Full routine site visits may be conducted by the
3Department for periodic evaluation. Such visits shall be used
4to determine compliance with this Act. Full routine site
5visits must be announced and may be waived at the discretion of
6the Department if the program maintains accreditation with an
7accrediting body recognized by the United States Department of
8Education and approved by the Department.
9    (d) Any institution conducting a registered professional
10nursing program that wishes to discontinue the program must do
11each of the following:
12        (1) Notify the Department, in writing, of its intent
13    to discontinue the program.
14        (2) Continue to meet the requirements of this Act and
15    the rules adopted thereunder until the official date of
16    termination of the program.
17        (3) Notify the Department of the date on which the
18    last student shall graduate from the program and the
19    program shall terminate.
20        (4) Assist remaining students in the continuation of
21    their education in the event of program termination prior
22    to the graduation of the program's final student.
23        (5) Upon the closure of the program, notify the

1programs planning to offer clinical practice experiences in
2this State must meet the requirements set forth in this
3Section and must meet the clinical and faculty requirements
4for institutions outside of this State, as established by
5rule. The institution responsible for conducting an
6out-of-State registered professional nursing education program
7and the administrator of the program shall be responsible for
8ensuring that the individual faculty and preceptors overseeing
9the clinical experience are academically and professionally
10competent.

17    Sec. 13. Department powers and duties.
18    (a) Subject to the provisions of this Act, the Department
19shall:
20        (1) adopt rules setting forth standards to be met by a
21    school or institution offering a course of training for
22    physician assistants prior to approval of such school or
23    institution, including the study of perimenopause and

1    menopause recognition and management;
2        (2) adopt rules setting forth uniform and reasonable
3    standards of instruction to be met prior to approval of
4    such course of institution for physician assistants; and
5        (3) determine the reputability and good standing of
6    such schools or institutions and their course of
7    instruction for physician assistants by reference to
8    compliance with such rules, provided that no school of
9    physician assistants that refuses admittance to applicants
10    solely on account of race, color, sex, or creed shall be
11    considered reputable and in good standing.
12    (b) No rule shall be adopted under this Act which allows a
13physician assistant to perform any act, task, or function
14primarily performed in the lawful practice of optometry under
15the Illinois Optometric Practice Act of 1987.
16    (c) All rules shall be submitted to the Board for review
17and the Department shall consider any comments provided by the
18Board.
