AMENDMENT TO SENATE BILL 3690

2    AMENDMENT NO. ______. Amend Senate Bill 3690 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Findings. The General Assembly finds that:
5        (1) in 1985, Mayor Harold Washington entered into an
6    intergovernmental agreement with the State of Illinois
7    whereby the State of Illinois could operate Illinois State
8    Lottery kiosks at O'Hare International Airport and,
9    subsequently, Chicago Midway International Airport; and
10        (2) in 1985, Governor James R. Thompson entered into
11    an intergovernmental agreement with the City of Chicago
12    whereby the Illinois State Police would patrol the
13    expressways in the City of Chicago.
 
14    Section 5. The Illinois Gambling Act is amended by
15changing Section 7.15 and by adding Section 7.16 as follows:

1    (230 ILCS 10/7.15)
2    Sec. 7.15. Limitations on gaming at Chicago airports. The
3Chicago casino may conduct gaming operations in an airport
4under the administration or control of the Chicago Department
5of Aviation. Gaming operations may be conducted pursuant to
6this Section so long as: (i) gaming operations are conducted
7in a secured area that is beyond the Transportation Security
8Administration security checkpoints and only available to
9airline passengers at least 21 years of age who are members of
10a private club, and not to the general public, (ii) gaming
11operations are limited to slot machines, as defined in Section
124 of the Illinois Gambling Act, and video gaming terminals, as
13defined in Section 5 of the Video Gaming Act, and (iii) the
14combined number of gaming positions operating in the City of
15Chicago at the airports and at the temporary and permanent
16casino facility does not exceed the maximum number of gaming
17positions authorized pursuant to subsection (h) of Section 7
18of the Illinois Gambling Act. Gaming operations at an airport
19are subject to all applicable laws and rules that apply to any
20other gaming facility under the Illinois Gambling Act.

23    Sec. 7.16. Distribution of revenue from gaming at Chicago
24airports. Beginning on the effective date of this amendatory
25Act of the 104th General Assembly, 10% of the gross receipts

1generated by gaming operations conducted under Section 7.15
2shall be distributed as follows:
3        (1) For revenue generated at the O'Hare International
4    Airport, 1/7 to any municipalities and governing bodies
5    that participate in a mutual aid agreement to serve O'Hare
6    International Airport, with no more than 50% of that
7    revenue distributed to contiguous municipalities, 1/7 to
8    City of Chicago ward facilities where the airport is
9    located, 1/7 to Chicago Park District facilities serving
10    the area where the airport is located, 1/7 to the Chicago
11    public schools serving the area where the airport is
12    located, 1/7 to Chicago Police Department facilities
13    serving the area where the airport is located, 1/7 to the
14    Residential Sound Insulation Program, and 1/7 to the
15    Illinois State Police. The funds distributed to the
16    Illinois State Police under this paragraph shall be
17    disbursed to the State Police Operations Assistance Fund
18    for costs associated with policing the Chicago
19    expressways.
20        (2) For revenue generated at the Chicago Midway
21    International Airport, 1/6 to City of Chicago ward
22    facilities where the airport is located, 1/6 to Chicago
23    Park District facilities serving the area where the
24    airport is located, 1/6 to the Chicago public schools
25    serving the area where the airport is located, 1/6 to
26    Chicago Police Department facilities serving the area

1    where the airport is located, 1/6 to the Residential Sound
2    Insulation Program, and 1/6 to the Illinois State Police.
3    The funds distributed to the Illinois State Police under
4    this paragraph shall be disbursed to the State Police
5    Operations Assistance Fund for costs associated with
6    policing the Chicago expressways.".
