SYNOPSIS AS INTRODUCED:

    Amends the Criminal Code of 2012. Provides that a person commits the offense of concealment of homicidal death when he or she knowingly permits the concealment or disposal of a body on property under the person's control with knowledge that the other person has died by homicidal means. Increases the penalty for concealment of homicidal death from a Class 3 felony to a Class 2 felony. Provides that a person commits the offense of concealment of death when he or she knowingly permits the concealment or disposal of a body on property under the person's control with the intent of concealing information regarding the place or manner of death of that person, or the identity of any person with information regarding the death of that person. Increases the penalty for concealment of death from a Class 4 felony to a Class 3 felony. Effective immediately.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by
5changing Sections 9-3.4 and 9-3.5 as follows:
 
6    (720 ILCS 5/9-3.4)  (was 720 ILCS 5/9-3.1)
7    Sec. 9-3.4. Concealment of homicidal death.
8    (a) A person commits the offense of concealment of
9homicidal death when he or she knowingly conceals the death of
10any other person with knowledge that such other person has
11died by homicidal means.
12    (a-5) A person commits the offense of concealment of
13homicidal death when he or she knowingly permits the
14concealment or disposal of a body on property under the
15person's control with knowledge that the other person has died
16by homicidal means.
17    (b) Nothing in this Section prevents the defendant from
18also being charged with and tried for the first degree murder,
19second degree murder, or involuntary manslaughter of the
20person whose death is concealed.
21    (b-5) For purposes of this Section:
22    "Conceal" means the performing of some act or acts for the
23purpose of preventing or delaying the discovery of a death by

1homicidal means. "Conceal" means something more than simply
2withholding knowledge or failing to disclose information.
3    "Homicidal means" means any act or acts, lawful or
4unlawful, of a person that cause the death of another person.
5    (c) Sentence. Concealment of homicidal death is a Class 2
63 felony.

9    Sec. 9-3.5. Concealment of death.
10    (a) For purposes of this Section, "conceal" means the
11performing of some act or acts for the purpose of preventing or
12delaying the discovery of a death. "Conceal" means something
13more than simply withholding knowledge or failing to disclose
14information.
15    (b) A person commits the offense of concealment of death
16when he or she knowingly conceals the death of any other person
17who died by other than homicidal means.
18    (c) A person commits the offense of concealment of death
19when he or she knowingly moves the body of a dead person from
20its place of death, with the intent of concealing information
21regarding the place or manner of death of that person, or the
22identity of any person with information regarding the death of
23that person. This subsection shall not apply to any movement
24of the body of a dead person by medical personnel, fire
25fighters, law enforcement officers, coroners, medical

1examiners, or licensed funeral directors, or by any person
2acting at the direction of medical personnel, fire fighters,
3law enforcement officers, coroners, medical examiners, or
4licensed funeral directors.
5    (c-5) A person commits the offense of concealment of death
6when he or she knowingly permits the concealment or disposal
7of a body on property under the person's control with the
8intent of concealing information regarding the place or manner
9of death of that person, or the identity of any person with
10information regarding the death of that person.
11    (d) Sentence. Concealment of death is a Class 3 4 felony.

13    Section 99. Effective date. This Act takes effect upon
