    Amends the Downstate Public Transportation Act. Provides, in Articles concerning Downstate Public Transportation Assistance and Nonurbanized Area Public Transportation Assistance, that the term "operating deficits" does not include revenue from advertising.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Downstate Public Transportation Act is
5amended by changing Sections 2-2.03, 3-1.03, and 4-1.11 as
6follows:
 
7    (30 ILCS 740/2-2.03)  (from Ch. 111 2/3, par. 662.03)
8    Sec. 2-2.03. "Operating deficits" means the amount by
9which eligible operating expenses exceed revenue from fares,
10reduced fare reimbursements, rental of properties,
11advertising, and any other amounts collected and received by a
12provider of public transportation, which, under standard
13accounting practices, are properly classified as operating
14revenue or operating income attributable to providing public
15transportation and revenue from any federal financial
16assistance received by the participant to defray operating
17expenses or deficits. For purposes of determining operating
18deficits, local effort from local taxes or its equivalent
19shall not be included as operating revenue or operating
20income. Provided, however, under the provisions of this Act
21with respect to any operating deficit incurred by any
22Metro-East Transit District participant, such operating
23deficits shall be limited solely to those arising out of

1operations within the State of Illinois.

4    Sec. 3-1.03. "Operating deficits" means the amount by

8providing public transportation under this Article which,
9under standard accounting practices for the providing of
10public transportation are properly classified as operating
11revenue or operating income attributable to providing public
12transportation under this Article. For purposes of determining
13operating deficits, operating revenue or operating income
14shall not include such funds as the Department may determine
15consistent with federal Department of Transportation
16regulations and requirements affecting Section 18.
