AMENDMENT TO SENATE BILL 3830

2    AMENDMENT NO. ______. Amend Senate Bill 3830 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Public Utilities Act is amended by adding
5Section 8-508.5 as follows:
 
6    (220 ILCS 5/8-508.5 new)
7    Sec. 8-508.5. Load curtailment of load-serving entities.
8    (a) Any order for load curtailment from PJM
9Interconnection, LLC (PJM) that is given to a load-serving
10entity and that concerns the load-serving entity's provision
11of service to a large load addition customer shall only apply
12to that large load addition customer and no other customer of
13the load-serving entity.
14    (b) Any obligation, financial or otherwise, that is
15assigned to a load-serving entity due to PJM's backstop
16procurement of new capacity or other comparable services shall

1be passed through to new large load addition customers under
2terms that are comparable to the terms under which PJM
3assigned the obligation to the load-serving entity.
4    (c) Each large load addition customer that triggers a PJM
5backstop procurement shall, as a condition of using service
6provided by a public utility, provide appropriate financial
7security to ensure that the public utility's existing
8customers are held harmless for the entire contract term and
9for the value of any backstop procurement obligation imposed
10by PJM.
11    (d) Any new large load addition customer that applies to a
12public utility for service shall submit information to PJM
13that includes, but is not limited to, the following:
14        (1) the large load addition's expected load usage;
15        (2) the large load addition's expected peak load;
16        (3) the large load addition's capacity utilization;
17        (4) whether the large load addition is dependent on
18    another proposed project moving forward; and
19        (5) any other information requested by PJM.
20    (e) Nothing in this Section is intended: (1) to prevent or
21hinder any action by a load-serving entity that is necessary
22to maintain the load-serving entity's system reliability; or
23(2) to prevent the load-serving entity from adopting
24appropriate voluntary load curtailment programs.".
