AMENDMENT TO SENATE BILL 3830

2    AMENDMENT NO. ______. Amend Senate Bill 3830 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Public Utilities Act is amended by adding
5Sections 3-106, 3-107, 3-108, and 8-508.5 as follows:
 
6    (220 ILCS 5/3-106 new)
7    Sec. 3-106. Load-serving entity. "Load-serving entity"
8means a public utility, an electric cooperative, an
9alternative retail electric supplier as defined in Section
1016-102, or a municipal utility.
 
11    (220 ILCS 5/3-107 new)
12    Sec. 3-107. Reliability backstop procurement. "Reliability
13backstop procurement" means any mechanism, however that
14mechanism is constituted, that is approved by PJM
15Interconnection, LLC (PJM) or the Midcontinent Independent

1System Operator (MISO) to procure long-term contracts for new
2capacity resources that are deemed necessary to ensure
3electric system reliability during periods when market-based
4approaches are insufficient to meet forecasted needs.
 
5    (220 ILCS 5/3-108 new)
6    Sec. 3-108. Electric distribution company. "Electric
7distribution company" means any entity that owns, operates, or
8leases with rights equivalent to ownership electric
9distribution facilities that are used to provide electric
10distribution service to any electric load in Illinois, whether
11or not the entity is subject to the jurisdiction of the
12Commission. "Electric distribution company" includes a public
13utility, an electric cooperative, and a municipal utility.
 
14    (220 ILCS 5/8-508.5 new)
15    Sec. 8-508.5. Hyperscale data center load curtailment.
16    (a) As used in this Section, "hyperscale data center"
17means a facility used primarily or exclusively for electronic
18information services, such as the management, storage,
19processing, and dissemination of electronic data and
20information through the use of computer systems, servers,
21networking equipment, and related components, where the total
22highest demand established by the facility during the most
23recent 12 consecutive monthly billing periods or a forecast of
24its next 12 consecutive monthly billing periods was more than

150,000 kilowatts.
2    (b) Any curtailment obligation or directive from a
3regional transmission organization assigned to a load-serving
4entity, transmission owner, or electric distribution company
5and associated with the load-serving entity's, transmission
6owner's, or electric distribution company's provision of
7service to a hyperscale data center shall be passed through to
8the hyperscale data center that gave rise to the curtailment
9obligation or directive to the extent possible, and no other
10customer shall be assigned any curtailment responsibility. Not
11excluding other possible bases for a regional transmission
12organization to assign curtailment to a load-serving entity,
13transmission owner, or electric distribution company based on
14large load service, which shall also be subject to this
15subsection (b), this subsection (b) shall apply to any
16hyperscale data centers operating under PJM's
17connect-and-manage framework or any other non-firm service
18status in PJM or MISO.
19    Nothing in this subsection (b) is intended to prevent or
20hinder any action by a load-serving entity or an electric
21distribution company that is necessary to maintain system
22reliability or the entity's or company's participation in
23voluntary load curtailment programs.
24    (c) Any financial or other obligation assigned in 2026,
252027, or 2028 to a load-serving entity associated with PJM's
26reliability backstop procurement of new capacity undertaken

1for large load additions, as defined by PJM, or another
2comparable service from a regional transmission organization,
3shall be passed through to each hyperscale data center that
4gave rise to the financial or other obligation to the extent
5possible, and no other customer of the load-serving entity
6shall be assigned any financial responsibility.
7    (d) Any financial or other obligation assigned in 2026,
82027, or 2028 to a load-serving entity associated with the
9reliability backstop procurement of new capacity for a
10regional shortfall shall be passed through to hyperscale data
11center customers scheduled to connect to the grid or increase
12the size of the customer's existing connection after April 28,
132025 in proportion to each hyperscale data center customer's
14requested capacity relative to the total requested capacity of
15the hyperscale data center customers that are served by the
16load-serving entity and under terms that are comparable to the
17terms under which the regional transmission organization
18assigned such obligation to the load-serving entity. No
19hyperscale data center customer that is assigned costs
20pursuant to subsection (c) shall be double charged.
21    (e) Each hyperscale data center customer seeking new or
22modified service shall, as a condition of taking service from
23any load-serving entity, provide appropriate financial
24security to ensure that the load-serving entity's existing
25customers are held harmless for the entire term and value of
26any reliability backstop procurement obligation imposed by a

1regional transmission organization. Public utilities shall
2file proposed tariffs to this effect with the Commission for
3approval within 90 days after the effective date of this
4amendatory Act of the 104th General Assembly, and the
5Commission shall open a docketed proceeding for the
6consideration and approval of such proposed tariffs in a
7timely manner thereafter.
8    (f) Any hyperscale data center applying to a load-serving
9entity for new or modified service shall submit detailed
10information to the load-serving entity, the relevant regional
11transmission organization, and the Commission, including at
12least the following:
13        (1) its expected load usage;
14        (2) its peak load;
15        (3) its utilization;
16        (4) its ramp rate; and
17        (5) any other information requested by the regional
18    transmission organization or the Commission.".
