| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Mental Health and Developmental |
| 5 | | Disabilities Code is amended by changing Section 1-129 as |
| 6 | | follows:

| 7 | | (405 ILCS 5/1-129) |
| 8 | | Sec. 1-129. Mental illness. "Mental illness" means a |
| 9 | | mental, or emotional disorder that substantially impairs a |
| 10 | | person's thought, perception of reality, emotional process, |
| 11 | | judgment, behavior, or ability to cope with the ordinary |
| 12 | | demands of life. "Mental illness" includes transgenderism, or |
| 13 | | the condition of identifying with a gender other than the one |
| 14 | | assigned at birth. "Mental illness" , but does not include a |
| 15 | | developmental disability, dementia or Alzheimer's disease |
| 16 | | absent psychosis, a substance use disorder, or an abnormality |
| 17 | | manifested only by repeated criminal or otherwise antisocial |
| 18 | | conduct. |
