SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/4-102 new

    Amends the Public Utilities Act. Provides that, subject to the provisions of the Public Contract Fraud Act, the Illinois Commerce Commission is authorized during fiscal years 2027 and 2028 to acquire real property located in Springfield, as necessary to carry out the duties vested in the Commission. Provides that real property may be acquired subject to any third-party interests in the property that do not prevent the Commission from beneficially using the property. Provides that the Executive Director of the Commission may enter into contracts relating to construction, reconstruction, or renovation projects for any buildings or lands acquired by the Commission, and contracts to equip, lease, repair, operate, and maintain real property as appropriate to carry out the duties of the Executive Director. Provides that the Executive Director, on behalf of the Commission, may enter into agreements for the purpose of exercising the Commission's authority. Provides that the exercise of the authority vested in the Commission to acquire property under the provision is subject to appropriation. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by adding
5Section 4-102 as follows:
 
6    (220 ILCS 5/4-102 new)
7    Sec. 4-102. Acquisition of real property in Springfield by
8the Commission.
9    (a) Subject to the provisions of the Public Contract Fraud
10Act, the Commission, on behalf of the State of Illinois, is
11authorized during State fiscal years 2027 and 2028 to acquire
12real property located in Springfield, which the Commission
13deems necessary to carry out the powers and duties vested in
14it. Real property acquired under this Section may be acquired
15subject to any third-party interests in the property that do
16not prevent the Commission from exercising the intended
17beneficial use of the property. This subsection (a) is
18inoperative on and after July 1, 2028.
19    (b) The Executive Director of the Commission may:
20        (1) enter into contracts relating to construction,
21    reconstruction, or renovation projects for any buildings
22    or lands acquired under subsection (a); and
23        (2) equip, lease, repair, operate, and maintain those

1    grounds, buildings, and facilities as is appropriate to
2    carry out the Executive Director of the Commission's
3    statutory purposes and duties.
4    (c) The Executive Director of the Commission, on behalf of
5the Commission, may enter into agreements for the purpose of
6exercising the Commission's authority under this Section.
7    (d) The exercise of the authority vested in the Commission
8to acquire property under this Section is subject to
9appropriation.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.
