AMENDMENT TO SENATE BILL 3974

2    AMENDMENT NO. ______. Amend Senate Bill 3974 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5adding Section 9.21 as follows:
 
6    (415 ILCS 5/9.21 new)
7    Sec. 9.21. Gas appliance labeling.
8    (a) No person shall sell, attempt to sell, or offer to sell
9to a consumer in this State a non-externally vented natural
10gas appliance that is manufactured on or after January 1,
112027, unless a label on the gas appliance bears the following
12message:
13        "WARNING: Gas appliances can release nitrogen dioxide
14    and carbon monoxide inside homes at levels exceeding
15    Environmental Protection Agency standards for outdoor air
16    quality. The presence of these pollutants may exacerbate

1    pre-existing respiratory illnesses or lead to the
2    development of asthma, especially in children. Gas
3    appliances should never be used without a ducted vent hood
4    to reduce exposure to these emissions."
5    (b) The label required under subsection (a) shall be
6attached to the gas appliance in a conspicuous location and in
7a type size no smaller than the largest type size used for
8other consumer information on the product.
9    (c) The Board may adopt rules setting forth additional
10requirements for the placement and formatting of the label
11required under subsection (a).
12    (d) A violation of this Section constitutes a violation of
13this Act.
14    (e) In this Section, "non-externally vented natural gas
15appliance" means a natural gas-fired appliance that exhausts
16combustion by-products into the indoor air of the building or
17dwelling unit in which it is installed and is not connected to
18a flue, chimney, or other duct designed to convey combustion
19gases to the outdoors. "Non-externally vented natural gas
20appliance" does not include (i) portable outdoor cooking
21appliances, laboratory equipment, or appliances intended
22exclusively for outdoor use or (ii) furnaces, boilers, water
23heaters, or other appliances that are required by the
24International Fuel Gas Code or the International Mechanical
25Code to be mechanically vented.".
