Amends the School Code. Provides that school personnel and the parents of students enrolled in a school district may file a complaint with the school board of the school district for any administrative or school board member malpractice. Requires a school board to create a process for filing complaints with the school board. Provides that if a school board receives more than one filed complaint about any one school board member or administrator of the school district, the school board shall report the complaints to the regional office of education with jurisdiction over and the State Board of Education. Provides that a school employee is immune from professional disciplinary action for submitting a complaint that is not made with willful or wanton misconduct. Provides that a student of a parent who submits a complaint may not have any disciplinary action or mistreatment made upon the student by school personnel or a school board member because the parent submitted a complaint. Provides that if school personnel have a good faith belief that a violation of the Criminal Code of 2012, the Illinois Vehicle Code, or a local ordinance has occurred on or off school grounds that is based on evidence received by school personnel on school grounds or at a school-sponsored event, the school personnel shall report the violation to the appropriate law enforcement authority. Provides that school personnel making a good faith report of a violation to the appropriate law enforcement agency are immune from criminal or civil liability or professional disciplinary action for making a good faith report that is not made with willful or wanton misconduct. Effective July 1, 2026.

A BILL FOR

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Sections 10-31 and 22-85.15 as follows:

(105 ILCS 5/10-31 new)

Sec. 10-31. Reporting administrative and school board member malpractice.

(a) In this Section:

"School personnel" means all employees of a school district, including administrators and licensed and nonlicensed school employees.

"Student" means a person or child enrolled in a school district.

(b) School personnel and the parents of students enrolled in a school district may file a complaint with the school board of the school district for any administrative or school board member malpractice, including, but not limited to:

(1) dereliction of duties included in State and federal law and school district policy;

(2) partiality toward one or more students in discipline decision-making; and

(3) refusal to take action on misconduct by a school board member, school personnel, or student if remedial action is required.

(c) A school board shall create a process for filing complaints with the school board under this Section. The process shall be made available to all parents or students enrolled in the school district and school personnel employed by the school district. The process shall be accessible on the school district's website. If there is no website maintained by the school district, the school district shall create a way for school personnel and parents to file a complaint via written or electronic methods.

(d) If a school board receives more than one filed complaint about any one school board member or administrator of the school district, the school board shall report the complaints to the regional office of education with jurisdiction over the school district and the State Board of Education.

(e) A school employee is immune from professional disciplinary action for submitting a complaint under this Section that is not made with willful or wanton misconduct. A student of a parent who submits a complaint under this Section may not have any disciplinary action or mistreatment made upon the student by school personnel or a school board member because the parent submitted a complaint.

Sec. 22-85.15. Mandatory reporting of criminal behavior.

(a) In this Section:

"Appropriate law enforcement" means the closest law enforcement agency in proximity to a school district.

"School personnel" means all employees of a school district, including administrators and licensed and nonlicensed school employees.

(b) If school personnel have a good faith belief that a violation of the Criminal Code of 2012, the Illinois Vehicle Code, or a local ordinance has occurred on or off school grounds that is based on evidence received by school personnel on school grounds or at a school-sponsored event, the school personnel shall report the violation to the appropriate law enforcement authority. School personnel making a good faith report of a violation to the appropriate law enforcement agency as required under this Section are immune from criminal or civil liability or professional disciplinary action for making a good faith report that is not made with willful or wanton misconduct.

Section 99. Effective date. This Act takes effect July 1, 2026.
