SYNOPSIS AS INTRODUCED:

    Amends the School Code. Provides that school personnel and the parents of students enrolled in a school district may file a complaint with the school board of the school district for any administrative or school board member malpractice. Requires a school board to create a process for filing complaints with the school board. Provides that if a school board receives more than one filed complaint about any one school board member or administrator of the school district, the school board shall report the complaints to the regional office of education with jurisdiction over and the State Board of Education. Provides that a school employee is immune from professional disciplinary action for submitting a complaint that is not made with willful or wanton misconduct. Provides that a student of a parent who submits a complaint may not have any disciplinary action or mistreatment made upon the student by school personnel or a school board member because the parent submitted a complaint. Provides that if school personnel have a good faith belief that a violation of the Criminal Code of 2012, the Illinois Vehicle Code, or a local ordinance has occurred on or off school grounds that is based on evidence received by school personnel on school grounds or at a school-sponsored event, the school personnel shall report the violation to the appropriate law enforcement authority. Provides that school personnel making a good faith report of a violation to the appropriate law enforcement agency are immune from criminal or civil liability or professional disciplinary action for making a good faith report that is not made with willful or wanton misconduct. Effective July 1, 2026.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Sections
510-31 and 22-85.15 as follows:
 
6    (105 ILCS 5/10-31 new)
7    Sec. 10-31. Reporting administrative and school board
8member malpractice.
9    (a) In this Section:
10    "School personnel" means all employees of a school
11district, including administrators and licensed and
12nonlicensed school employees.
13    "Student" means a person or child enrolled in a school
14district.
15    (b) School personnel and the parents of students enrolled
16in a school district may file a complaint with the school board
17of the school district for any administrative or school board
18member malpractice, including, but not limited to:
19        (1) dereliction of duties included in State and
20    federal law and school district policy;
21        (2) partiality toward one or more students in
22    discipline decision-making; and
23        (3) refusal to take action on misconduct by a school

1    board member, school personnel, or student if remedial
2    action is required.
3    (c) A school board shall create a process for filing
4complaints with the school board under this Section. The
5process shall be made available to all parents or students
6enrolled in the school district and school personnel employed
7by the school district. The process shall be accessible on the
8school district's website. If there is no website maintained
9by the school district, the school district shall create a way
10for school personnel and parents to file a complaint via
11written or electronic methods.
12    (d) If a school board receives more than one filed
13complaint about any one school board member or administrator
14of the school district, the school board shall report the
15complaints to the regional office of education with
16jurisdiction over the school district and the State Board of
17Education.
18    (e) A school employee is immune from professional
19disciplinary action for submitting a complaint under this
20Section that is not made with willful or wanton misconduct. A
21student of a parent who submits a complaint under this Section
22may not have any disciplinary action or mistreatment made upon
23the student by school personnel or a school board member
24because the parent submitted a complaint.

2    (a) In this Section:
3    "Appropriate law enforcement" means the closest law
4enforcement agency in proximity to a school district.
5    "School personnel" means all employees of a school
6district, including administrators and licensed and
7nonlicensed school employees.
8    (b) If school personnel have a good faith belief that a
9violation of the Criminal Code of 2012, the Illinois Vehicle
10Code, or a local ordinance has occurred on or off school
11grounds that is based on evidence received by school personnel
12on school grounds or at a school-sponsored event, the school
13personnel shall report the violation to the appropriate law
14enforcement authority. School personnel making a good faith
15report of a violation to the appropriate law enforcement
16agency as required under this Section are immune from criminal
17or civil liability or professional disciplinary action for
18making a good faith report that is not made with willful or
19wanton misconduct.
 
20    Section 99. Effective date. This Act takes effect July 1,
212026.
