SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/10-21.7  from Ch. 122, par. 10-21.7

    Amends the School Code. Provides that beginning July 1, 2026, each school district shall determine a plan for responding to all incidents of battery committed by students against teachers and other school personnel, which shall include reporting and documentation procedures, student safety plans, behavioral intervention plans, and remedies for injured teachers and school personnel. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
510-21.7 as follows:
 
6    (105 ILCS 5/10-21.7)  (from Ch. 122, par. 10-21.7)
7    Sec. 10-21.7. Attacks on school personnel.
8    (a) In the Section, "school" means any public or private
9elementary or secondary school.
10    (b) Upon receipt of a written complaint from any school
11personnel, the school shall report all incidents of battery
12committed against teachers, teacher personnel, administrative
13personnel or educational support personnel to the local law
14enforcement authorities immediately after the occurrence of
15the attack. Schools shall also report all of these incidents
16to the State Board of Education through existing school
17incident reporting systems as they occur during the year by no
18later than August 1 for the preceding school year. The State
19Board of Education shall report data by school district, as
20collected from school districts, in an annual report of
21attacks on school personnel and make it available to the
22public via its website. The local law enforcement authority
23shall, by March 1 of each year, report the required data from

1the previous year to the Illinois State Police's Illinois
2Uniform Crime Reporting Program.
3    (c) Beginning July 1, 2026, each school district shall, in
4good faith cooperation with its teachers or, where applicable,
5with the exclusive bargaining representatives of its teachers,
6determine a plan for responding to all incidents of battery
7committed by students against teachers and other school
8personnel. Plans must include, but are not limited to,
9reporting and documentation procedures, student safety plans,
10behavioral intervention plans, and remedies for injured
11teachers and school personnel.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.
