Makes appropriations for the ordinary and contingent expenses of the Environmental Protection Agency for the fiscal year beginning July 1, 2026, as follows:

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

ARTICLE 1

Section 5. The following named amounts, or so much thereof as may be necessary, respectively, for objects and purposes hereinafter named, are appropriated to meet the ordinary and contingent expenses of the Environmental Protection Agency for:

Section 10. The sum of $1,450,000, or so much thereof as may be necessary, is appropriated to the Environmental Protection Agency from the EPA Special State Projects Trust Fund for the purpose of funding all costs associated with environmental programs, including prior years' costs.

Section 15. The sum of $400,000, or so much thereof as may be necessary, is appropriated from the U.S. Environmental Protection Fund to the Environmental Protection Agency for all costs associated with environmental projects as defined by federal assistance awards.

Section 20. The sum of $250,000, or so much thereof as may be necessary, is appropriated from the Oil Spill Response Fund to the Environmental Protection Agency for use in accordance with Section 25c-1 of the Environmental Protection Act.

Section 25. The amount of $4,000,000, or so much thereof as may be necessary, is appropriated from the Environmental Protection Trust Fund to the Environmental Protection Agency for awards and grants as directed by the Environmental Protection Trust Fund Commission.

Section 30. The sum of $32,000,000, or so much thereof as may be necessary, is appropriated to the Environmental Protection Agency from the Motor Fuel Tax Fund for deposit into the Vehicle Inspection Fund.

Section 35. The sum of $38,000,000, or so much thereof as may be necessary is appropriated to the Environmental Protection Agency from the EPA Court Trust Fund for all costs associated and allowable uses under Court Orders and Settlements entered on behalf of or by the Illinois Environmental Protection Agency

Section 50. The sum of $2,000,000, or so much thereof as may be necessary, is appropriated from the U.S. Environmental Protection Fund to the Environmental Protection Agency for expenses and grants connected with the Climate Pollution Reduction Grant planning program as authorized by Section 60114 of the Inflation Reduction Act (IRA) of 2022.

Section 55. The sum of $150,000, or so much thereof as may be necessary, is appropriated from the Alternative Compliance Market Account Fund to the Environmental Protection Agency for all costs associated with the emissions reduction market program.

LABORATORY SERVICES

Section 60. The sum of $1,300,000, or so much thereof as may be necessary, is appropriated from the Community Water Supply Laboratory Fund to the Environmental Protection Agency for the purpose of performing laboratory testing of samples from community water supplies and for administrative costs of the Agency and the Community Water Supply Testing Council.

Section 65. The sum of $600,000, or so much thereof as may be necessary, is appropriated from the Environmental Laboratory Certification Fund to the Environmental Protection Agency for the purpose of administering the laboratory certification program.

Section 70. The sum of $2,800,000, or so much thereof as may be necessary, is appropriated from the Illinois Clean Water Fund to the Environmental Protection Agency for the purpose of laboratory analysis of samples.

Section 75. The sum of $1,000,000, or so much thereof as may be necessary, is appropriated from the Solid Waste Management Fund to the Environmental Protection Agency for the purpose of laboratory analysis of samples.

Section 100. The sum of $11,500,000, or so much therefore as may be necessary, is appropriated from the Solid Waste Management Fund to the Environmental Protection Agency for all costs associated with solid waste management activities, including prior years' costs.

Section 105. The sum of $3,500,000, or so much thereof as may be necessary, is appropriated from the Subtitle D Management Fund to the Environmental Protection Agency for the purpose of funding the Subtitle D permit program in accordance with Section 22.44 of the Environmental Protection Act.

Section 110. The sum of $5,000,000, or so much thereof as may be necessary, is appropriated from the Brownfields Redevelopment Fund to the Environmental Protection Agency for all expenses related to the Municipal Brownfields Redevelopment Grant program.

Section 115. The sum of $4,500,000, or so much thereof as may be necessary, is appropriated from the Brownfields Redevelopment Fund to the Environmental Protection Agency for financial assistance for Brownfields redevelopment in accordance with 58.3(5), 58.13 and 58.15 of the Environmental Protection Act, including prior years' costs.

Section 120. The sum of $2,500,000, or so much thereof as may be necessary, is appropriated from the Brownfields Redevelopment Fund to the Environmental Protection Agency for all expenses related to the Brownfields Community Wide Assessment Program.

Section 130. The sum of $3,000,000, or so much thereof as may be necessary, is appropriated from the Drycleaner Environmental Response Trust Fund to the Environmental Protection Agency for use in accordance with the Drycleaner Environmental Response Trust Fund Act, including prior years' costs.

Section 135. The sum of $2,000,000, or so much thereof as may be necessary, is appropriated from the Renewable Energy Resources Trust Fund to the Environmental Protection Agency to provide a grant to Joliet Junior College for purposes of funding education and training for renewable energy and energy efficiency technology, and for the operations and services of the Illinois Green Economy Network, pursuant to Section 6-5 of the Renewable Energy, Energy Efficiency, and Coal Resources Development Law of 1997.

Section 145. The following named sums, or so much thereof as may be necessary, are appropriated to the Environmental Protection Agency for use in accordance with Section 22.2 of the Environmental Protection Act: Payable from the Hazardous Waste Fund: For all expenses related to Hazardous Waste

Section 150. The sum of $1,300,000, or so much thereof as may be necessary, is appropriated from the Environmental Protection Trust Fund to the Environmental Protection Agency for all expenses related to removal or mediation actions at the Worthy Park, Cook County, hazardous waste site.

Section 155. The sum of $6,500,600, or so much thereof as may be necessary, is appropriated from the Environmental Protection Permit and Inspection Fund to the Environmental Protection Agency for all costs associated with land permit and inspection activities.

Section 160. The sum of $51,500,000, or so much thereof as may be necessary, is appropriated from the Environmental Disaster and Remediation Fund to the Environmental Protection Agency for the purpose of funding any inspection, remedial, and corrective action, and post-closure activities, in accordance with the Environmental Protection Act, including prior years' costs.

Section 165. The sum of $2,200,000, or so much thereof as may be necessary, is appropriated from the Federal Energy Fund to the Environmental Protection Agency for expenses and grants connected with the HOMES Rebate Program as authorized by Section 50121 of the Inflation Reduction Act of 2022 (IRA) and the HEEHRA Rebate Program by Section 50122 of the Inflation Reduction Act of 2022 (IRA).

Section 170. The sum of $2,000,000, or so much thereof as may be necessary, is appropriated from the Federal Energy Fund to the Environmental Protection Agency for expenses and grants connected with the Energy Audit Training Program.

Section 175. The sum of $7,000,000, or so much thereof as may be necessary, is appropriated from the Federal Energy Fund to the Environmental Protection Agency for expenses and grants connected with enforcement of the Illinois Energy Conservation Code.

Section 180. The sum of $6,000,000, or so much thereof as may be necessary, is appropriated from the Federal Energy Fund to the Environmental Protection Agency for expenses and grants connected with the State Energy Program, including prior years' costs.

Section 185. The sum of $14,260,000, or so much thereof as may be necessary, is appropriated from the Federal Energy Fund to the Environmental Protection Agency for costs associated with State Energy Programs as authorized by Title I of Division D in Section 40109 of the Infrastructure Investment and Jobs Act (IIJA), including prior years' cost.

Section 190. The sum of $1,250,000, or so much thereof as may be necessary, is appropriated from the Federal Energy Fund to the Environmental Protection Agency for costs associated with the Energy Revolving Loan Program as authorized by Title V of Division D in Section 40502 of the Infrastructure and Investment and Jobs Act (IIJA), including prior years' cost.

Section 195. The sum of $2,910,000, or so much thereof as may be necessary, is appropriated from the Federal Energy Fund to the Environmental Protection Agency for costs associated with the Energy Efficiency and Conservation Block Grant Program as authorized by Title V of Division D of the Infrastructure and Investment and Jobs Act (IIJA) in accordance with Section 544 of the Energy Independence and Security Act of 2007, including prior years' cost.

Section 200. The sum of $6,000,000, or so much thereof as may be necessary, is appropriated from the Federal Energy Fund to the Environmental Protection Agency for expenses relating to various federal projects.

Section 205. The sum of $5,000,000, or so much thereof as may be necessary, is appropriated from the Energy Efficiency Trust Fund to the Environmental Protection Agency for grants pursuant to subsection (b) of Section 6-6 of the Renewable Energy, Energy Efficiency, and Coal Resources Development Law of 1997.

Section 210. The sum of $200,000, or so much thereof as may be necessary, is appropriated from the Energy Efficiency Trust Fund to the Environmental Protection Agency for operational expenses related to administering grants made pursuant to subsection (b) of Section 6-6 of the Renewable Energy, Energy Efficiency, and Coal Resources Development Law of 1997.

Section 215. The sum of $7,100,000, or so much thereof as may be necessary, is appropriated to the Environmental Protection Agency from the Federal Energy Fund for all costs associated with the Contractor Training Grant Program, including prior years' costs.

Section 220. The sum of $400,000, or so much thereof as may be necessary, is appropriated from the Carbon Dioxide Sequestration Administrative Fund to the Environmental Protection Agency for all costs associated with the Safety and Aid for the Environment in Carbon Capture and Sequestration Act (SAFE CCS Act).

Section 225. The sum of $100,000, or so much thereof as may be necessary, is appropriated from the Environmental Justice Grant Fund to the Environmental Protection Agency for all costs associated with issuance of grants in accordance with the Safety and Aid for the Environment in Carbon Capture and Sequestration Act (SAFE CCS Act).

Section 230. The following named amounts, or so much thereof as may be necessary, respectively, for objects and purposes hereinafter named, are appropriated to meet the ordinary and contingent expenses of the Environmental Protection Agency for:

Section 240. The sum of $17,000,000, or so much thereof as may be necessary, is appropriated from the Illinois Clean Water Fund to the Environmental Protection Agency for all costs associated with clean water activities.

Section 245. The sum of $6,000,000, or so much thereof as may be necessary, is appropriated from the Environmental Protection Permit and Inspection Fund to the Environmental Protection Agency for all costs associated with water permit and inspection activities.

Section 250. The sum of $8,000,000, or so much thereof as may be necessary, is appropriated to the Environmental Protection Agency from the Clean Water State Revolving Fund for all costs associated with Environmental Management System (EMS) Services for the Bureau of Water.

POLLUTION CONTROL BOARD DIVISION

Section 255. The amount of $2,290,300, or so much thereof as may be necessary, is appropriated from the Underground Storage Tank Fund to the Environmental Protection Agency for case processing of leaking underground storage tank permit and claims appeals.

Section 260. The sum of $789,900, or so much thereof as may be necessary, is appropriated from the Clean Air Act Permit Fund to the Environmental Protection Agency for costs associated with the handling of appeals from permitting and other determinations made by the Environmental Protection Agency.

Section 265. The following named amounts, or so much thereof as may be necessary, respectively, are appropriated to the Environmental Protection Agency for the objects and purposes hereinafter named, to meet the ordinary and contingent expenses of the Pollution Control Board Division. Payable from Pollution Control Board Fund: For Operational Expenses.............................15,000 For Refunds...........................................2,000

Section 270. The amount of $526,400, or so much thereof as may be necessary, is appropriated from the Used Tire Management Fund to the Environmental Protection Agency for the purposes as provided for in Section 55.6 of the Environmental Protection Act.

Section 275. The sum of $1,322,000, or so much thereof as may be necessary, is appropriated from the Environmental Protection Permit and Inspection Fund to the Environmental Protection Agency for costs associated with handling appeals from permitting and other determinations made by the Environmental Protection Agency.

ARTICLE 2

Section 5. The sum of $25,000,000, or so much thereof as may be necessary, and remains unexpended, at the close of business on June 30, 2026, from the appropriation heretofore made in Article 79, Section 5, of Public Act 104-0003 as amended, is reappropriated from the VW Settlement Environmental Mitigation Fund to the Environmental Protection Agency for all costs, including administrative expenses, associated with funding eligible mitigation actions that achieve reductions of emissions in accordance with the Environmental Mitigation Trust Agreement relating to the Partial Consent Decree between U.S. Department of Justice, Volkswagen AG and other settling defendants.

Section 10. The sum of $15,832,287, or so much thereof as may be necessary, and remains unexpended, at the close of business on June 30, 2026, from the appropriations heretofore made in Article 78, Section 200 and Article 79, Section 10, of Public Act 104-0003 as amended, is reappropriated from the Energy Efficiency Trust Fund to the Environmental Protection Agency for grants pursuant to subsection (b) of Section 6-6 of the Renewable Energy, Energy Efficiency, and Coal Resources Development Law of 1997.

Section 15. The sum of $2,227,103, or so much thereof as may be necessary and remains unexpended at the close of business on June 30, 2026, from the appropriations heretofore made in Article 78, Section 225 and Article 79, Section 15 of Public Act 104-0003, as amended, is reappropriated from the U.S. Environmental Protection Fund to the Environmental Protection Agency for enforcement of actions under the Gulf Hypoxia Action Plan pursuant to the Infrastructure Investment and Jobs Act (IIJA).

Section 20. The sum of $5,000,000, or so much thereof as may be necessary and remains unexpended at the close of business on June 30, 2026, from the appropriation heretofore made in Article 78, Section 110, of Public Act 104-0003, as amended, is reappropriated from the Brownfields Redevelopment Fund to the Environmental Protection Agency for all expenses related to the Municipal Brownfields Redevelopment Grant program.

Section 99. Effective date. This Act takes effect July 1, 2026.
