SYNOPSIS AS INTRODUCED:

    Provides that the Act may be referred to as Reverend Jesse Jackson Day Act. Declares findings. Amends the State Commemorative Dates Act to commemorate October 8 as a holiday to be known as Reverend Jesse Jackson Day to honor the life and legacy of Reverend Jesse Louis Jackson, Sr., a long-time Illinois resident, ordained Baptist minister, and national civil rights leader. Provides that, when the eighth day of October falls on a Sunday, the following Monday shall be held and considered the holiday. Amends the Election Code, the Illinois Procurement Code, the School Code, and the Promissory Note and Bank Holiday Act to include Reverend Jesse Jackson Day as a holiday. Effective immediately.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. References to Act. This Act may be referred to
5as Reverend Jesse Jackson Day Act.
 
6    Section 3. Findings. The General Assembly finds that:
7        (1) Reverend Jesse Louis Jackson, Sr., born October 8,
8    1941, in Greenville, South Carolina, rose to become one of
9    the most influential civil rights leaders in American
10    history.
11        (2) As founder of Rainbow PUSH Coalition, Rev. Jackson
12    advanced economic justice, voting rights, labor rights,
13    educational equity, and international human rights.
14        (3) Rev. Jackson was a protege of Dr. Martin Luther
15    King, Jr., and played a pivotal role in the Civil Rights
16    Movement.
17        (4) Through his historic presidential campaigns in
18    1984 and 1988, Rev. Jackson expanded political
19    participation and representation for African Americans and
20    other marginalized communities.
21        (5) Rev. Jackson made Chicago, Illinois, his home and
22    transformed the political and moral landscape of this
23    State and the nation.

1        (6) His affirmation that "I Am Somebody" instilled
2    dignity and purpose in generations of Illinois residents.
3        (7) It is fitting and proper that the State of
4    Illinois permanently honor his life and legacy.
 
5    Section 5. The State Commemorative Dates Act is amended by
6adding Section 66 as follows:

8    Sec. 66. Reverend Jesse Jackson Day. The eighth day in
9October of each year is a holiday to be observed throughout the
10State and to be known as Reverend Jesse Jackson Day to honor
11the life and legacy of the Reverend Jesse Louis Jackson, Sr., a
12long-time resident of Illinois, an ordained Baptist minister,
13and a national civil rights leader. The Governor may annually
14issue a proclamation announcing the holiday and may designate
15official events held in honor of the memory of the Reverend
16Jesse Louis Jackson, Sr., and his contributions. When the
17eighth day of October falls on a Sunday, the following Monday
18shall be held and considered the holiday.
 
19    Section 10. The Election Code is amended by changing
20Section 1-6 as follows:

1Sunday, and holidays.
2    (a) If the first or last day fixed by law to do any act
3required or allowed by this Code falls on a State holiday or a
4Saturday or a Sunday, the period shall extend through the
5first business day next following the day otherwise fixed as
6the first or last day, irrespective of whether any election
7authority or local election official conducts business on the
8State holiday, Saturday, or Sunday.
9    (b) For the purposes of this Section, "State holiday"
10means New Year's Day, Dr. Martin Luther King, Jr.'s Birthday,
11Lincoln's Birthday, President's Day, Casimir Pulaski's
12Birthday, Good Friday, Memorial Day, Juneteenth National
13Freedom Day, Independence Day, Labor Day, Reverend Jesse
14Jackson Day, Columbus Day, Veterans' Day, Thanksgiving Day,
15Christmas Day, and any other day from time to time declared by
16the President of the United States or the Governor of Illinois
17to be a day during which the agencies of the State of Illinois
18that are ordinarily open to do business with the public shall
19be closed for business.
20    (c) Notwithstanding any other provision of this Code,
21nominating papers, petitions of objection to nominating
22papers, certificates of withdrawal of candidacy, and reports
23of political committees actually received by election
24authorities and local election officials on a State holiday, a
25Saturday, or a Sunday shall not be deemed invalid or defective
26for that reason alone.

2    Section 15. The Illinois Procurement Code is amended by
3changing Section 15-45 as follows:
 
4    (30 ILCS 500/15-45)
5    Sec. 15-45. Computation of days. The time within which any
6act provided in this Code is to be done shall be computed by
7excluding the first day and including the last, unless the
8last day is Saturday or Sunday or is a holiday, and then it
9shall also be excluded. If the day succeeding a Saturday,
10Sunday, or holiday is also a holiday, a Saturday, or a Sunday,
11then that succeeding day shall also be excluded. For the
12purposes of this Code, "holiday" means: New Year's Day; Dr.
13Martin Luther King, Jr.'s Birthday; Lincoln's Birthday;
14President's Day; Memorial Day; Juneteenth National Freedom
15Day; Independence Day; Labor Day; Reverend Jesse Jackson Day;
16Columbus Day; Veterans' Day; Thanksgiving Day; Christmas Day;
17and any other day from time to time declared by the President
18of the United States or the Governor of Illinois to be a day
19during which the agencies of the State of Illinois that are
20ordinarily open to do business with the public shall be closed
21for business.
22    Notwithstanding any other provision of State law to the
23contrary, November 3, 2020 shall be a State holiday known as

5    Section 20. The School Code is amended by changing Section
624-2 as follows:
 
7    (105 ILCS 5/24-2)
8    Sec. 24-2. Holidays.
9    (a) Teachers shall not be required to teach on Saturdays,
10nor, except as provided in subsection (b) of this Section,
11shall teachers, educational support personnel employees, or
12other school employees, other than noncertificated school
13employees whose presence is necessary because of an emergency
14or for the continued operation and maintenance of school
15facilities or property, be required to work on legal school
16holidays, which are January 1, New Year's Day; the third
17Monday in January, the Birthday of Dr. Martin Luther King,
18Jr.; February 12, the Birthday of President Abraham Lincoln;
19the first Monday in March (to be known as Casimir Pulaski's
20birthday); Good Friday; the day designated as Memorial Day by
21federal law; June 19, Juneteenth National Freedom Day; July 4,
22Independence Day; the first Monday in September, Labor Day;
23October 8, Reverend Jesse Jackson Day; the second Monday in
24October, Columbus Day; November 11, Veterans' Day; the

1Thursday in November commonly called Thanksgiving Day; and
2December 25, Christmas Day. School boards may grant special
3holidays whenever in their judgment such action is advisable.
4No deduction shall be made from the time or compensation of a
5school employee, including an educational support personnel
6employee, on account of any legal or special holiday in which
7that employee would have otherwise been scheduled to work but
8for the legal or special holiday.
9    (b) A school board or other entity eligible to apply for
10waivers and modifications under Section 2-3.25g of this Code
11is authorized to hold school or schedule teachers' institutes,
12parent-teacher conferences, or staff development on the third
13Monday in January (the Birthday of Dr. Martin Luther King,
14Jr.); February 12 (the Birthday of President Abraham Lincoln);
15the first Monday in March (known as Casimir Pulaski's
16birthday); the second Monday in October (Columbus Day); and
17November 11 (Veterans' Day), provided that:
18        (1) the person or persons honored by the holiday are
19    recognized through instructional activities conducted on
20    that day or, if the day is not used for student attendance,
21    on the first school day preceding or following that day;
22    and
23        (2) the entity that chooses to exercise this authority
24    first holds a public hearing about the proposal. The
25    entity shall provide notice preceding the public hearing
26    to both educators and parents. The notice shall set forth

1    the time, date, and place of the hearing, describe the
2    proposal, and indicate that the entity will take testimony
3    from educators and parents about the proposal.
4    (c) Commemorative holidays, which recognize specified
5patriotic, civic, cultural or historical persons, activities,
6or events, are regular school days. Commemorative holidays
7are: January 17 (the birthday of Muhammad Ali), January 28 (to
8be known as Christa McAuliffe Day and observed as a
9commemoration of space exploration), February 15 (the birthday
10of Susan B. Anthony), March 29 (Viet Nam War Veterans' Day),
11the last Friday in April (Arbor and Bird Day), September 11
12(September 11th Day of Remembrance), September 17
13(Constitution Day), the school day immediately preceding
14Veterans' Day (Korean War Veterans' Day), October 1 (Recycling
15Day), October 7 (Iraq and Afghanistan Veterans Remembrance
16Day), October 9 (Leif Erikson Day), the day immediately after
17Thanksgiving (Native American Heritage Day), December 7 (Pearl
18Harbor Veterans' Day), and any day so appointed by the
19President or Governor. School boards may establish
20commemorative holidays whenever in their judgment such action
21is advisable. School boards may include instruction relative
22to commemorated persons, activities, or events on the
23commemorative holiday or at any other time during the school
24year and at any point in the curriculum when such instruction
25may be deemed appropriate. The State Board of Education may
26prepare and make available to school boards instructional

1materials relative to commemorated persons, activities, or
2events which may be used by school boards in conjunction with
3any instruction provided pursuant to this paragraph.
4    (d) City of Chicago School District 299 shall observe
5March 4 of each year as a commemorative holiday. This holiday
6shall be known as Mayors' Day which shall be a day to
7commemorate and be reminded of the past Chief Executive
8Officers of the City of Chicago, and in particular the late
9Mayor Richard J. Daley and the late Mayor Harold Washington.
10If March 4 falls on a Saturday or Sunday, Mayors' Day shall be
11observed on the following Monday.
12    (e) Notwithstanding any other provision of State law to
13the contrary, November 3, 2020 shall be a State holiday known
14as 2020 General Election Day and shall be observed throughout
15the State pursuant to Public Act 101-642. All government
16offices, with the exception of election authorities, shall be
17closed unless authorized to be used as a location for election
18day services or as a polling place.
19    Notwithstanding any other provision of State law to the
20contrary, November 8, 2022 shall be a State holiday known as
212022 General Election Day and shall be observed throughout the
22State under Public Act 102-15.
23    Notwithstanding any other provision of State law to the
24contrary, November 5, 2024 shall be a State holiday known as
252024 General Election Day and shall be observed throughout
26this State pursuant to Public Act 103-467.

4    Section 25. The Promissory Note and Bank Holiday Act is
5amended by changing Section 17 as follows:
 
6    (205 ILCS 630/17)  (from Ch. 17, par. 2201)
7    Sec. 17. Holidays.
8    (a) The following days shall be legal holidays in the
9State of Illinois upon which day a bank may, but is not
10required to, remain closed:
11    the first day of January (New Year's Day);
12    the third Monday in January (observance of Martin Luther
13King, Jr.'s birthday);
14    the twelfth day in February (Abraham Lincoln's birthday);
15    the third Monday in February (Presidents Day);
16    the first Monday in March (observance of Casimir Pulaski's
17birthday);
18    the Friday preceding Easter Sunday (Good Friday);
19    the last Monday of May (Memorial Day);
20    the nineteenth day of June (Juneteenth National Freedom
21Day);
22    the fourth day of July (Independence Day);
23    the first Monday in September (Labor Day);
24    the eighth day of October (Reverend Jesse Jackson Day);

1    the second Monday in October (Columbus Day);
2    the eleventh day of November (Veterans' Day);
3    the fourth Thursday in November (Thanksgiving Day);
4    the twenty-fifth day in December (Christmas Day);
5    the days upon which the general elections for members of
6the House of Representatives are held, and any day proclaimed
7by the Governor of this State as a legal holiday. From 12
8o'clock noon to 12 o'clock midnight of each Saturday shall be
9considered a half holiday. In addition to such holidays and
10half-holidays, a bank may select one day of the week to remain
11closed, as provided in subsection (b) of this Section.
12    (b) Any bank doing business within this State may select
13any one day of the week to remain closed on a regular basis
14upon adoption of a resolution by the board of directors of such
15bank designating the day selected and upon filing and
16publishing a copy of such resolution as hereinafter required.
17Any such resolution shall be deemed effective for the purpose
18of this Section only when a copy thereof, certified by an
19officer having charge of the records of such bank, is filed
20with the Recorder of the county in which such bank is located
21and published once each week for 3 successive weeks in a
22newspaper of general circulation in such county. Such
23publication shall be accomplished by, and at the expense of,
24the bank, and the bank shall submit to the Commissioner of
25Banks and Real Estate such evidence of the publication as the
26Commissioner shall deem appropriate. Any such selection shall

1remain in full force and effect until a copy of the later
2resolution of the board of directors of such bank, certified
3in like manner, terminating or altering any such prior
4selection shall be filed and published in the same manner as
5such prior resolution.
6    (c) If an occasion arises when a state bank wishes to
7remain closed on a particular day, other than a day on which
8the bank has selected to remain closed on a regular basis as
9provided in this Section, such state bank may remain closed on
10such an occasion after first sending to the Commissioner a
11copy of a resolution adopted by the board of directors
12authorizing the bank to remain closed on such occasion and
13notice of the intent to remain closed on such occasion shall be
14conspicuously posted in the lobby of the main banking office
15and any branches of such bank for at least 3 weeks in advance
16of such occasion. Any day which any bank doing business within
17the State shall select to remain closed pursuant to this
18Section shall, with respect to such bank, be treated and
19considered as a Sunday.
20    (d) All legal holidays, the half holidays and any day
21selected by a bank doing business within the State to remain
22closed, shall, for all purposes whatsoever, as regards the
23presenting for payment or acceptance, the maturity and
24protesting and giving of notice of the dishonor of bills of
25exchange, bank checks and promissory notes and other
26negotiable or commercial paper or instrument, be treated and

1considered as a Sunday. When any such holidays, except
2Juneteenth National Freedom Day, fall on Sunday, the Monday
3next following shall be held and considered such holiday. All
4notes, bills, drafts, checks or other evidence of
5indebtedness, falling due or maturing on either of such days,
6shall be deemed as due or maturing upon the day following, and
7when 2 or more of these days come together, or immediately
8succeeding each other, then such instruments, paper or
9indebtedness shall be deemed as due or having matured on the
10day following the last of such days.
11    (e) Any act authorized, required or permitted to be
12performed at or by or with respect to any bank doing business
13within the State on a day which it has selected to remain
14closed under this Section may be so performed on the next
15succeeding business day and no liability or loss of rights of
16any kind shall result from such delay.
17    (f) Nothing in this Act shall in any manner affect the
18validity of, or render void or voidable, the payment,
19certification, or acceptance of a check or other negotiable
20instrument, or any other transaction by a bank in this State,
21because done or performed on any Saturday, Sunday, holiday, or
22any day selected by a bank to remain closed, or during any time
23other than regular banking hours; but no bank in this State,
24which by law or custom is entitled to remain open or to close
25for the whole or any part of any day selected by it to remain
26open or to close, is compelled to close, or to remain open for

1the transaction of business or to perform any of the acts or
2transactions aforesaid except at its own option.

4    Section 99. Effective date. This Act takes effect upon
5becoming law.
