Amends the Interagency Wetland Policy Act of 1989. Makes technical changes in a Section concerning the short title.

 In the opinion of DCCA, HB 422(HA #1) creates a local government organization and structure mandate for which reimbursement of the increased costs to units of local government is not required under the State Mandates Act. Due to the nature of this bill, an estimate of the increased cost to units of local government cannot be determined. The City of Chicago and Cook County are exempt from the requirements of the legislation. In addition, units of local government in northeastern Illinois are also exempt from HB 422 (HA #1) if they (1) have a stormwater management program under Section 5-1062 of the Counties Code; and (2) already meet requirements outlined in the legislation as amended.

 House Bill 422, as amended by House Amendment #2, would cost the Illinois EPA approximately $450,000 per year for five (5) new headcount to be phased in over 18-24 months. This figure includes approximately $50,000 for other related resources.

 Housing Affordability Impact Note (H-AM 5)(Housing Development Authority)
 While a self-sustaining permit fee process is contemplated in the text of this bill, it is difficult to determine if, or how, the housing developers will pass these costs onto the homebuyers/homeowners. House Amendment No. 5 provides no further classification or factors which determine this bill's fiscal effect on constructing, purchasing, owning, or selling a single-family residence.

 Fiscal Note (H-AM 5)(Dept. of Natural Resources)
 Permit fees will be set at levels that will allow the program to operate financially on a self-sustaining basis, thus, no net costs to the State after initial startup of program. Initial startup costs are estimated to be $350,000, which will be necessary to implement provisions of the Act. A proposal must be proposed to the Pollution Control Board within 90 days of the effective date of this Act and within six months of receiving this proposal, the Pollution Control Board must adopt by rule a fee schedule to implement the Act. The Department of Natural Resources shall evaluate fees annually to determine if the program is self-sustaining and propose necessary changes to the Pollution Control Board if necessary. The Department's initial revenue projections based on an internally developed fee schedule and respective classifications necessary to maintain a self-sustaining programs is estimated to be $2 million. A fee schedule to this extent will be forwarded to the Pollution Control Board.
